Description:
Delivery of magnetic resonance imaging with assembly and commissioning

1. The subject of the contract is the supply of magnetic resonance imaging with assembly and commissioning for Copernicus PL Sp. z o.o.

2. The item of the order was not divided into parts.

3. A detailed description of the subject of the contract specifying the requirements of the Ordering Party, quantity, is included

in Appendix No. 3 to SWZ – Description of the Subject of the Order and in Annex No. 6 to SWZ – Draft Agreement.

By completing the items indicated in Annex 3 to the SWZ, the Contractor confirms compliance with the requirements specified

by the Ordering Party.

4. The offered objects of the contract must be complete, of a high standard both in terms of

quality and functionality, as well as free from material, construction and legal defects.

5. The offered objects of the contract must be released for circulation and use in accordance with the applicable

legal regulations.

1. The subject of the contract is the delivery of magnetic resonance imaging together with assembly and commissioning for Copernicus Przedsiębiorstwo Leczniczy Sp. z o.o.

2. The item of the order was not divided into parts.

3. Name of the item according to the Common Procurement Vocabulary: 33100000-1 Medical devices, 33111600-7 Radiographic devices, 51411000-6 – Imaging equipment installation services, 7132000 – Design engineering services.

4. As part of the subject of the contract, the Contractor will be obliged to sell, together with storage, delivery to the place indicated in the description of the subject of the contract, assembly, commissioning, adaptation and commissioning of medical equipment (alternatively referred to as the "Device") described in Annex 3 to the SWZ – OPZ.

5. A detailed description of the subject of the contract, specifying the requirements of the Ordering Party and the quantity, is included in Annex 3 to the SWZ – Description of the Subject of the Order and in Annex 6 to the SWZ – Draft Agreement. By completing the items indicated in this Annex, the Contractor confirms compliance with the requirements specified by the Contracting Authority.

6. The offered subject of the contract must be complete, of a high standard both in terms of quality and functionality, as well as free from material, construction and legal defects.

7. The offered subject of the order must be admitted to trading and use in accordance with applicable law.

8. In all provisions of the SWZ and its annexes, in which the Contracting Authority refers to standards, approvals, technical specifications or reference systems or indicates trademarks, parameters or sources of origin (names of manufacturers or devices), in accordance with Article 99 paragraph 5 and Article 101 paragraph 4 of the PPL, the Contracting Authority shall allow equivalent solutions.

9. The subject of the contract must comply with the Act of 7 April 2022 on medical devices (i.e. Journal of Laws 2022.974 of 2022.05.09.), if the Ordering Party requires offering an assortment constituting a medical device.

10. The Contracting Authority shall not reserve the right to apply for a contract only by the Contractors referred to in Article 94 of the PPL.

11. The contracting authority does not impose the requirements referred to in Article 96 of the PPL.

12. Planned source of financing: Purchase planned under the grant m.in. – "Improving access to high-quality specialist health services for the treatment of civilization diseases of the inhabitants of Pomerania through the expansion of St. Adalbert's Hospital in Gdańsk".

13. The Contracting Authority reserves the right to cancel the procurement procedure if the funds from the subsidy from point 12 of this paragraph, which the Contracting Authority intended to allocate to finance the contract, are not granted to it.

14. Deadline for the contract:

delivery of medical equipment to the Contractor's Warehouse by 1 December 2023,

the procedure of quantitative acceptance of Medical Equipment – no later than 1 December. The Contractor shall notify the Contracting Authority of this fact no later than 7 days before the date of completion of the acceptance procedure,

transport of medical equipment from the warehouse to the destination and assembly and commissioning of the equipment, performance of all adaptation works and obtaining all necessary permits enabling the commencement of services using medical equipment within 120 days from the date of signing the contract.
