The subject of the contract are services in the field of forest management as defined in Article 6 paragraph 1 point 1 of the Act of 28 September 1991 on forests (consolidated text: Journal of Laws of 2021, item 1275, as amended – "Forest Act") covering works in the field of forest breeding and protection, fire protection, harvesting and skidding of wood to be performed in the area of the Turek Forest District in 2023.The proceedings are conducted in accordance with the rules provided for the so-called "procedure reversed', referred to in Article 139(1), (3) to (4) of the Public Procurement Law. The contracting authority will first examine and evaluate the bids, and then it will make a subjective qualification of the Contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure. The present proceedings are the next proceedings on the part No. 3 and No. 5 of the contract entitled "Provision of forest management services in the area of the Turek Forest District in 2023" zn. spr. SA.270.3.9.2022, which have been invalidated.

The subject of the contract are services in the field of forest management in accordance with the definition in Article 6 paragraph 1 point 1 of the Act of 28 September 1991 on forests (consolidated text: Journal of Laws of 2021, item 1275, as amended – "Forest Act") covering works in the field of forest breeding and protection, fire protection, harvesting and skidding wood to be performed in the area of the Turek Forest District in 2023 in a given package.The material scope of the subject of the contract includes the total quantities of works resulting from Annex 2 to the SWZ, which consists of: Appendix No. 2.1. planned size of works; Appendix No. 2.2. - detailed size of works by groups of activities, activities and location; Appendix 2.3.1. – forestry characteristics in terms of timber harvesting; Appendix No. 2.3.2. – assortment system of timber harvesting in forestry; Appendix No. 2.3.3. – a list of distances and conditions of skidding wood; Appendix No. 2.3.4. – list of items with additional difficulties in obtaining and skidding; Appendix 2.3.5. – list of items not available for machine acquisition; Appendix 2.3.6. – information on the optimal technology of logging

Quality standards relating to all essential features of the subject of the contract are set out in Annex 3 to the SWZ, which consists of:Annex 3.1. "Description of the standard of forestry work performance technology" adopted by Decision No. 34 of the General Director of the State Forests of May 12, 2022 on the introduction of the "Description of the standard of forestry work performance technology" in organizational units of the State Forests along with the changes introduced by amending decisions; Appendix No. 3.2.Description of the standard of forestry work performance technology in the Regional Directorate of State Forests in Poznań, adopted by Decision No. 41 of the Regional Director of the State Forests of 06.10.2022 on the introduction of the "Regional description of the standard of forestry work". The Ordering Party reserves the right to make decreasing corrections, increasing corrections, arrangements of new locations, as well as to suspend the activities indicated in individual rows of tables describing the subject of the contract in the circumstances described in the SWZ. The Contracting Authority does not reserve the obligation for the Contractor to personally perform key tasks related to the subject of the contract. Pursuant to Article 95 of the Public Procurement Law, the Contracting Authority requires the Contractor or subcontractor to employ on the basis of an employment relationship persons performing activities in the field of contract performance consisting in the acquisition and skidding of wood raw material, if the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 - Labour Code. Specialist equipment that the Contractor plans to use to perform works and subject to technical inspection should be registered in the Office of Technical Inspection and have a current admission to work (UDT decisions). Sprayers that the Contractor plans to use to perform the work should have up-to-date inspections. Any work requiring authorization to perform them may be performed by persons who are allowed to perform these works. The contracting authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Public Procurement Law within 3 years from the date of award of the basic contract up to 50% of the estimated basic value of this contract. The deposit for Package No. 3 is PLN 14,000. Performance bond - 2% of the total price for the Package.
