The subject of the order is the delivery of a brand new disk array (together with software) free from legal and physical defects - hereinafter referred to as the "Hardware" - for the purpose of supplementing (expanding) the existing IT infrastructure at the Ordering Party. Further information on the description of the Equipment and the scope of delivery is provided in section II.2.4) of the announcement, and the information in the indicated scope is provided in full and exhaustive terms of reference. Whenever the following term is used in the announcement, it should be understood: 1) the Public Procurement Law – the Polish Act of 11.09.2019 – the Public Procurement Law, 2) the Terms of Reference – the procurement document referred to in Articles 133 and 134 of the Public Procurement Law with annexes, including the Model Agreement, prepared for the present procedure (and the open tender procedure); 3) Model Agreement – the proposed provisions of the procurement agreement, the content of which is provided in Appendix No. 9 to the Terms of Reference

1. Description of minimum technical requirements and other types of properties of the Equipment - as provided in the Terms of Reference.

2. The scope of delivery which is the subject of this order shall include a minimum:

1) Sale and delivery of the offered Equipment to the Ordering Party in the place indicated

Section II.2.3) of the notice (hereinafter referred to as the "Equipment Delivery Site"). This location is specified in detail in the SWZ;

2) Granting the Ordering Party a warranty for the offered Equipment (details in this regard, including the minimum required warranty period - as stated in the Terms of Reference);

3) Providing the Contracting Authority with appropriate licenses entitling the Contracting Authority

to legally use the offered computer programs (software) required in the Terms of Use and any other computer programs that – as components or affiliations – are necessary for the use of the Equipment on the part of the Ordering Party or will be offered, in accordance with the requirements in this respect specified in the Terms of Reference;

4) Issuance of the relevant documentation of the Equipment to the Ordering Party, as a requirement at the stage of acceptance of the Equipment (the type and required documents at least creeping into the documentation as specified above in the Terms of Reference).

3. The scope shall also include the following ancillary benefits requiring the performance of the

In a full and detailed manner, the services comprising the scope of the supply referred to in paragraphs 2 and 3 above, which is the subject of this contract, as well as other conditions of its performance – shall be included in the provisions of the Terms of Reference, including in particular the Model Agreement.
