The subject of the contract is the service of collection by the Contractor of waste with code 19 12 12 from the installation of mechanical waste processing, hereinafter referred to as ballast waste, in the amount of 3 000 Mg in order to manage them, in accordance with the decisions held by the Contractor.

The subject of the contract is the service of collection by the Contractor of waste with code 19 12 12 from the installation of mechanical waste processing, hereinafter referred to as ballast waste, in the amount of 3 000 Mg in order to manage them, in accordance with the decisions held by the Contractor. 1) Type of waste Waste is the residue after sorting of mixed municipal waste and separately collected fractions of plastic and paper, devoid of: a) a sub-sieve fraction up to 80 mm constituting input for the biological treatment of waste; (b) plastic raw materials sorted by means of an optopneumatic device; (c) waste from ferrous and non-ferrous metal scrap sorted with ferrous and non-ferrous metal separators; (d) glass waste sorted by hand in the pre-selection booth; e) cardboard packaging sorted by hand from fractions over 260 mm. 2) Method of order execution: a) ballast waste will be prepared by the Ordering Party in a loose form; b) collection of ballast waste will take place from the premises of the Waste Management Plant in Zakurzewo near Grudziądz; c) the collection of waste will take place in vehicles at the Disposal of the Contractor, at his expense, also in terms of transport costs, insurance for the time of transport and unloading, in accordance with the provisions of the Act of 14 December 2012 on waste (i.e. Journal of Laws of 2022, item 699), the Act of 20 June 1997. Road Traffic Law (i.e. Journal of Laws of 2022, item 988) and the Act of 6 September 2001 on road transport (i.e. Journal of Laws of 2022, item 180, as amended); d) loading of waste on vehicles substituted by the Contractor will be carried out by the Ordering Party using a VOLVO 110G or VOLVO 110H wheel loader, in a designated place on the premises of the Waste Management Plant in Zakurzewo near Grudziądz; e) the contractor will collect waste on an ongoing basis, continuously, on all working days, i.e. from Monday to Friday, excluding holidays, from 7:00 to 14:00; f) the contractor during the performance of the contract is obliged to comply with the rules of traffic organization in force at the Waste Management Plant and to apply the recommendations of the Ordering Party's staff regarding the loading of waste; g) the maximum daily amount of waste to be collected by the Contractor is 50 Mg; h) the Ordering Party stipulates that the amount of waste referred to above is an estimated quantity and may therefore be reduced, with the proviso that the Ordering Party guarantees the transfer for collection and management of at least 70% of the total amount of ballast waste referred to above. Due to the Failure of the Ordering Party to realize the estimated quantity in full, subject to the guaranteed quantity, the Contractor shall not be entitled to any claims; i) the waste collected by the Contractor will be weighed on a truck scale located on the premises of the Waste Management Plant in Zakurzewo. To determine the weight of the waste to be collected, the Contractor's vehicle must also be weighed before entering the area indicated above; j) upon transfer of waste by the Ordering Party to the Contractor, the Contractor assumes responsibility for the seized waste, for proper handling of it and the consequences resulting from it; k) the contractor shall be solely responsible for any damage, as well as for loss, loss and damage to waste, arising during transport and during unloading of waste, unless they arose solely for reasons attributable to the Ordering Party. The Contractor shall in particular be liable for the acts of omission of its staff and carriers.
