The subject of the order is the expansion of the computing cluster for the needs of the Artificial Intelligence Center of UAM – the subject of the order has been divided into 3 parts. The subject of the order is described in Annex A to the SWZ. Part 1, 2, 3 - The order must be executed: within 60 days from the date of signing the contract and receiving confirmation from the appropriate supervisory authority of the Contracting Authority in accordance with Article 83(14)(1) in connection with Article 83(1)(26)(a) of the Act of March 11, 2004 on goods and services tax (Journal of Laws of 2024, item 361, as amended) or receiving information that it is not possible to issue such confirmation by the appropriate supervisory authority of the Contracting Authority (the execution deadline is a criterion for evaluating offers). The execution deadline is one of the evaluation criteria for offers. The Contractor shall deliver the subject of the order at their own expense and risk to the locations specified by the Contracting Authority. Domestic and foreign transport including insurance, all customs and fiscal fees, and any other fees are the responsibility of the Contractor. The Contractor shall attach to the offer the required evidence in the following form: technical description of the offered subject of the order, containing all necessary information allowing for the evaluation of compliance of the offer with the description of the subject of the order – Annex A to the SWZ (i.e. in particular, catalog cards of the offered devices, informational brochures, a summary containing specifications of the offered devices' manufacturer and model, configuration and parameters in Polish, etc.); the Contracting Authority anticipates supplementing the required evidence based on Article 107(2) of the Public Procurement Law; Minimum warranty and service conditions - according to SWZ. The Contracting Authority allows for the submission of equivalent offers. The Contractor may offer equipment with the same or better technical, quality, and functional parameters that meet the minimum parameters determined by the Contracting Authority in Annex A to the SWZ. In the event that there are trademarks in the description of the subject of the order, the Contractor may offer equivalent assortment that is no worse than the assortment specified by the Contracting Authority. The equivalent assortment must meet the condition that it is at least of the same class, or with the same parameters as expected by the Contracting Authority, i.e., the equivalent assortment must meet or exceed the technical and operational requirements described by the Contracting Authority in the SWZ. The Contractor who refers to equivalent solutions described by the Contracting Authority is obliged to demonstrate that the equipment it offers meets the requirements specified by the Contracting Authority, in particular by means of the required evidence, that the supplies offered meet the requirements, characteristics, or criteria defined by the Contracting Authority. The Contracting Authority accepts equivalent required evidence if it confirms that the offered supplies meet the requirements, characteristics, or criteria specified by the Contracting Authority.
