The subject of the public procurement includes: 1. delivery of equipment for upgrading the existing server infrastructure to provide centralized computing resources for the needs of the Ministry of Health and subordinate budget agencies with a budget towards the Ministry of Health (hereinafter referred to for brevity as “the equipment”), detailed by type, quantity, and technical specifications in the Technical Specification of the Contracting Authority - Appendix No. 1. The Contractor shall deliver: - Processor blocks - 14 pieces; - RAM - 168 pieces; - Disk array with 100 TB usable capacity – 1 piece; - Specialized solution for storing backup copies with a usable capacity of 100TB – 1 piece; - Backup system – 1 piece; - Scalable disk system of type Scale-out NAS – 1 piece. 2. warranty service for the delivered equipment under item 1, provided within the warranty service period according to the manufacturer's requirements, the requirements of the contract, and its appendices. The execution requirements are detailed in the Technical Specification of the Contracting Authority - Appendix No. 1, an integral part of the public procurement documentation. ****** Execution deadlines: 1. The delivery of equipment (hardware and software) is to be completed within 7 months from the date of notification of the Contractor for secured funding under the contract and submission by the Contractor of the established performance guarantee, under the conditions of the contract draft. 2. The warranty service period is in accordance with the period proposed by the participant in its offer, starting from the date of the acceptance protocol for the delivery of the equipment (hardware and software). **** In the event that the participant is not a manufacturer, it must be duly authorized by the manufacturer or its official representative for the right to distribute/sell and warranty service of the offered software and hardware products on the territory of the Republic of Bulgaria. The participant proves its compliance with this requirement by submitting an authorization letter or any equivalent document issued by the manufacturer or its official representative in Bulgarian or accompanied by a translation into Bulgarian in its Technical proposal. In cases where the Participant submits an authorization letter from the official representative of the manufacturer (or an equivalent document), the offer shall also include an authorization letter issued by the manufacturer (or an equivalent document in Bulgarian or accompanied by a translation into Bulgarian), which empowers the official representative of the manufacturer to provide authorization to third parties. **** The requirement for authorization at the stage of submitting offers is justified by the subject of the procurement and represents a guarantee for its timely and quality execution. If a contractor is chosen who is refused authorization by the manufacturer, this may lead to delays in the performance of the public procurement, as well as to its termination. According to the conclusions of the Supreme Administrative Court, “the requirement for authorization is not restrictive in itself, as it is a guarantee for the quality and reliability of the service provided. In ordinary commercial practice, authorization is based on a contract, which can be directly with the manufacturer or with another economic entity authorized to authorize on behalf of the manufacturer” (Decision No. 10859 of 27.10.2021 of the Supreme Administrative Court in adm. case No. 6546/2021, VII). In the documentation, the condition for authorization is broadly set, i.e., it is not limited solely to the manufacturer of the equipment but also to any of its official representatives. General authorization is required, rather than for a specific procedure, and an opportunity is provided for any interested participant – partner, whether a Bulgarian or foreign entity, to submit an offer, as the possibility is provided for proving the above-mentioned circumstance, both with an authorization letter and with any other equivalent document that certifies compliance with the specified requirement.
