The subject of this contract is a service consisting in the implementation of the Functional and Utility Program hereinafter: PFU together with obtaining an environmental decision for the investment entitled: "Construction of the bypass of the City of Zabrze along the provincial road No. 921 along with the extension of Hagera Street".

The subject of this contract is a service consisting in the implementation of the Functional and Utility Program hereinafter: PFU together with obtaining an environmental decision for the investment entitled: "Construction of the bypass of the City of Zabrze along the provincial road No. 921 along with the extension of Hagera Street".
PFU should precisely indicate the requirements of the Contracting Authority regarding the full scope of design works, as well as the scope of necessary formal and legal documentation and construction works,
taking into account the division into stages, in the manner specified in Annex 1 to the SWZ – Detailed description of the subject of the contract, i.e.
I stage – includes a section of the provincial road No. 921 along Przystanek Street from the intersection
with Mikulczycka street (SK-02) to the intersection with Hagera street (SK-03) (without extension of the intersection) in km from 0+000 to approx. 0+440,00
Stage II – includes a section of the voivodeship road No. 921 along Hagera street from the intersection with Tarnopolska street / DK88 (SK-01) to the intersection with Bytomska street (SK-06-W) (without the construction of a road junction) in km from 0+000 to km approx. 1+600
Stage III – includes the construction of a new road section from the intersection with Bytomska Street along with the construction of a road junction at the intersection of Bytomska/Hagera Street (SK-06-W) to the intersection with Wolności Street (without extension of the intersection with Wolności Street) (SK-10) in km from approx. 1+600 to km approx. 3+660
IIIa stage – includes the construction of a new road section from the intersection with the planned Nowo Hagera street (SK08) to the intersection of Pawliczka/Korczoka streets (SK-09) in km from 0+000 to km approx. 0+600
IV stage – includes the construction of a section of the road from the intersection with Wolności Street (SK-10) to the intersection with 3 Maja Street (SK-12) at km approx. 3+660 to km approx. 4+947 along with the extension of intersections.
Attention:
In the area of the intersection of the provincial road No. 921 – Mikulczycka Street and Przystanek Street (SK-02), the communication of the planned (according to a separate study) transfer center should be taken into account.
In the area of the intersection of 3 Maja, Winklera and Makoszowska (SK-13) streets, the communication of the planned (according to a separate study) transfer center should be taken into account.
PFU should be developed in a manner consistent with applicable regulations, in particular in accordance with the Regulation of the Minister of Development and Technology of 20 December 2021 on the detailed scope and form of design documentation, technical specifications for the execution and acceptance of construction works and the functional and utility program (Journal of Laws of 2021, item 2454, as amended) Chapter 4 – Scope and form of the functional and utility program from § 15 to § 20 of the above-mentioned regulation. In the event of a change in the regulations, the PFU should take into account the requirements of the law as at the date of transfer of the work.
As part of the PFU, the costs of the entire project should be calculated, in accordance with the Regulation of the Minister of Development and Technology of 29 December 2021 on determining the methods and bases for preparing the investor's cost estimate, calculating the planned costs of design works and the planned costs of construction works specified in the functional and utility program, divided into stages.
As part of the contract, the Contractor is also obliged to obtain a legally valid environmental decision, based on previously obtained documents, arrangements, provisions and decisions necessary to obtain it.
An application for a decision on environmental conditions should be developed and submitted in accordance with applicable regulations and guidelines, in particular based on the provisions of the Act of 3 October 2008 on the provision of information on the environment and its protection, public participation in environmental protection and environmental impact assessments. (Journal of Laws of 2008, No. 199, item 1227, as amended) and the Regulation of the Council of Ministers of 10 September 2019 on projects that may have a significant impact on the environment (Journal of Laws of 2019, item 1839). In the event of a change in regulations, the environmental decision should take into account the requirements of the law as at the date of transfer of the work.
