The subject of the contract is a service consisting in carrying out animation, cultural and educational activities as well as integrating, consolidating the process of introducing new social functions to the area of Project 8 ROCŁ and its immediate surroundings. The Order consists of 3 tasks in accordance with the Description of the Subject of the Order constituting Annex No. 1 to the SWZ. Delivery period - 3 months.

CONTRACT FOR SOCIAL AND OTHER SPECIFIC SERVICES at the award of which the provisions of the Act of 11 September 2019 - Public Procurement Law, applicable to classic contracts, with a value equal to or exceeding the EU thresholds - if the value of the contract expressed in PLN is equal to or exceeds the equivalent of EUR 750,000, taking into account the changes resulting from Section IV, Chapter 4 of the PPL.

4.5 The Contracting Authority does not specify the requirements for employment by the Contractor or subcontractor on the basis of an employment relationship of persons performing activities within the scope of contract performance, because the performance of these activities does not consist, in the opinion of the Contracting Authority, in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code.

THE GROUNDS FOR EXCLUSION FROM THE PUBLIC PROCUREMENT PROCEDURE are described in point 7 of the SWZ.

9.3.2 In order to demonstrate the absence of grounds for exclusion from the Procurement Procedure of the Contractor, the Contracting Authority requests the following documents:

9.3.2.1 Statements of the Contractor in the scope of Article 108 section 1 point 5 of the PPL Act on the lack of belonging to the same capital group within the meaning of the Act of 16 February 2007 on competition and consumer protection (consolidated text: Journal of Laws of 2021, item 275) with another Contractor who submitted a separate offer, or statements on belonging to the same capital group together with documents or information confirming the preparation of the offer independently of another Contractor belonging to the same capital group – the model statement is attached as Annex 9 to the SWZ.

9.3.2.2 Statements of the Contractor on the validity of the information contained in the statement referred to:

- in Article 125(1) of the PPL (i.e. in the single ESPD) to the extent relating to the grounds for exclusion indicated in Article 108(1)(3)-(6) of the PPL,

- Article 5k of Regulation 833/2014 as amended by Regulation 2022/576 and Article 7(1) of the Law on special arrangements for counteracting support for aggression against Ukraine and serving the protection of national security.

The model statement is attached as Annex 5a to the SWZ. In the case of contractors jointly applying for the contract, the Contractor's statement on the validity of the information contained in the ESPD shall be submitted by each of these Contractors (also applies to partners in a civil law partnership).

9.3.2.3 If the Contractor refers to the resources of other entities, a statement on the validity of the information contained in the statement referred to in:

- Article 125(1) of the PPL (i.e. in the single ESPD) to the extent relating to the grounds for exclusion indicated in Article 108(1)(3)-(6) of the PPL,

- Article 5k of Regulation 833/2014 as amended by Regulation 2022/576 and Article 7(1) of the Act on special arrangements for counteracting support for aggression against Ukraine and serving the protection of national security, is also submitted by each of these entities - model Annex 5b to the SWZ.

9.3.2.4 Information from the National Criminal Register regarding the grounds for exclusion specified in Article 108(1)(1), (2) and (4) of the PPL, drawn up no earlier than 6 months before its submission.
