Description of the subject of the order
a) The subject of the public procurement is the delivery involving the purchase and installation of variable message signs (DIP) in the City of Kraków as part of the development of Intelligent Transport Systems.
b) The scope of the order includes the execution of, among other things:
- delivery of DIP signs along with installation,
- creation of a project covering the scope of the task,
- construction of a dedicated fiber optic and electrical network,
- connection of signs to the public transport management system.
c) The contracting authority has described the subject of the order with the following documents:
- Draft provisions of the contract (PPU) constituting Annex No. 2 to the SWZ,
- Description of the subject of the order (OPZ) along with attachments constituting Annex No. 5 to the SWZ,
d) The contracting authority informs that a funding agreement No. FENX.03.01–IP.02–0011/24-00 for the project "Development of intelligent transport systems (ITS) improving communication accessibility in the City of Kraków" has been concluded under action FENX.03.01 Urban Transport priority FENX.03 Urban Transport of the European Funds for Infrastructure, Climate, Environment Program 2021-2027.
e) In the case of any attachments to the SWZ mentioning brand names, trademarks, standards, approvals, technical specifications, and reference systems, products may be replaced with equivalent ones. The contracting authority will recognize equivalent solutions as those that allow for achieving the effect intended by the contracting authority using other technical solutions. An identical (the same) solution cannot be considered equivalent, only those that in the compared features indicate exactly the same or very similar utility value. By specifying producer names, trademarks, standards, approvals, or reference systems, the contracting authority aimed to determine the minimum quality parameters and utility features that the goods must meet to satisfy the requirements set by the contracting authority and serve solely as a quality pattern for the subject of the order. Through the recording of minimum requirements for quality parameters, the contracting authority understands the requirements of goods contained in publicly available sources, catalogs, manufacturer websites, and similar. Operating example producer names serves solely for refining the level of the contracting authority's expectations in relation to a specific solution. The contracting authority informs that whenever the project documentation and technical specifications for the execution and acceptance of construction works have indicated the origin (brand, trademark, manufacturer, supplier) of materials or specified standards, approvals, technical specifications or reference systems referred to in Article 101 of the Public Procurement Law, the contracting authority allows the offering of materials or "equivalent" solutions in terms of technical, utility and operational parameters, provided that they guarantee the performance of works in accordance with the issued building permit and ensure obtaining technical parameters no worse than those assumed in this SWZ, and that their use will achieve the functionality of the Subject of the Order to no lesser degree than using the solutions used in the project by the contractor.
f) The contractor is required to provide:
- a minimum of 36 months quality warranty for the subject of the contract,
- a maximum of 60 months quality warranty for the subject of the contract,
Note! Offers containing a quality warranty period for the subject of the contract shorter than 36 months will be rejected.
g) The contracting authority, in accordance with Article 95 paragraph 1 of the PZP, requires the contractor or subcontractor to employ, on the basis of an employment relationship, persons performing the following tasks:
- lower-level technical staff (organizing and carrying out field work related to installation),
- physical workers (directly carrying out installation and other field work).
Note! The contracting authority allows the possibility of personal execution of the order by individuals running a business or partners of a commercial company.
h) The contracting authority does not require submitting an offer after conducting a site visit and checking by the contractor the documents necessary for the execution of the order available on-site with the contracting authority.
