The aim is to determine market values and compensation, on the basis of which the required land for the Free State of Thuringia can be acquired and/or used during construction in accordance with the planning approval. A qualified market value and compensation determination with in-depth research of the entire situation around the affected properties is required, which requires a detailed inspection, documentation and evaluation of the property including all affected buildings and plantings indoors and outdoors. The results are to be presented in a complete, comprehensive, comprehensible and court-proof expert opinion and explained in an understandable way.
A valuation for the subsequent real estate is required for the owners, as compensation for the loss of rights that occurs. The valuation/compensation determinations for the specific affected parties are to be presented in the individual appraisals/individual valuations (six), which at the same time form an appraisal for the entire construction project.
The valuation objects are built-up leisure/recreation areas (private garden), undeveloped open spaces, park, dam, foreland of the water body and the water body. The exact extent to which each property to be valued - size, location, type of use - is shown in the attached land acquisition register (GEV) and excerpt from the land acquisition plan (GEP).
Essentially, the following is required in the course of the above-mentioned services:
- Determination of the market value of developed or undeveloped land with all associated components and rights as well as any upright buildings and growth, including the determination of ancillary compensation for other ascertainable financial disadvantages, taking into account the principles of expropriation and compensation law and the client's requirements (within the meaning of §§ 95, 96 and 194 BauGB);
- Determination of compensation for temporary use. The compensation is to be calculated on the basis of a limitation for one year;
- Determination of the compensation for the creation of an easement for a walking/cycling/maintenance path to be built.
