The subject of the order is to provide the Ordering Party in the SaaS (Software as a Service) mode of the Educational Services Platform, including the following functionalities: conducting recruitment to schools, creating organization sheets, recording the duration of children in kindergartens, a school diary, and student records; services: secretariats, club rooms, canteens, school libraries, subsidies for schools, payroll and staff.

A detailed description of the subject of the contract is included in Annex 1 to the Model contract constituting Annex 4 to the ToR

1. The subject of the order is to provide the Ordering Party in the SaaS (Software as a Service) mode of the Educational Services Platform, including the following functionalities: conducting recruitment to schools, creating organization sheets, recording the duration of children in kindergartens, a school diary, and student records; services: secretariats, club rooms, canteens, school libraries, subsidies for schools, payroll and staff. The subject of the contract will be divided into two phases: the implementation phase and the access phase.

2. The Awarding Entity shall apply the reverse procedure referred to in art. 24aa Pzp. In accordance with art. 24aa Pzp, the Employer will first evaluate the offers and then examine whether the Contractor whose tender will be initially assessed as the most advantageous, is not subject to exclusion and meets the conditions for participation in the procedure. The contracting authority will perform activities resulting from art. 87, art. 89 and 90 paragraph 1 of the Public Procurement Law. However, in relation to the pre-selected Contractor, he will perform a subjective analysis in terms of the grounds for exclusion and fulfillment of the conditions for participation in the procedure.

3. Each Contractor is obliged to secure a bid bond of PLN 100,000.00. The bid bond must be lodged before the bid submission deadline in one or several forms, depending on the Contractor's choice specified in Chapter. XVIII SIWZ. The bid bond in cash shall be transferred by bank transfer to the Purchaser's bank account.

4. Before commencing the procedure for awarding a public contract in order to prepare a description of the subject of the contract, the Commune of Olsztyn conducted a technical dialogue. The documentation of the technical dialogue conducted by the Olsztyn Commune constitutes an attachment to the ToR.

5. In the public procurement procedure, communication between the Employer and Contractors takes place using electronic means of communication within the meaning of the Act of 18.7.2002 on the provision of electronic services (i.e. Journal of Laws of 2017, item 1219, as amended ) through:

6. The offer should be submitted electronically using the dedicated Form to submit, change, withdraw the offer, available on ePUAP and also available on the miniPortal at: https://miniportal.uzp.gov.pl.
