1. The subject of the contract is the construction, execution of the necessary checks and start-ups and commissioning of the DN 400 high-pressure gas pipeline together with the accompanying infrastructure constituting Task No. 1B of the investment project entitled "Construction of the Lubienia – Masłów gas pipeline and the Mójcza – Kielce gas pipeline" (Works), in accordance with the design documentation (Documentation).

2. The Contracting Authority informs that the personal data transmitted will be processed in accordance with the information contained in the “Information Obligation” available on the Ordering Party's website at www.psgaz.pl, in the tab: For Counterparty/Information Obligation.

1. (4.1. SWZ) The subject of the contract is the construction, execution of the necessary checks and start-ups, as well as the commissioning of the high-pressure gas pipeline DN 400 together with the accompanying infrastructure constituting Task No. 1B of the investment project entitled "Construction of the Lubienia - Masłów gas pipeline and the Mójcza - Kielce gas pipeline" (Works), in accordance with the design documentation (Documentation).

Details of the Description of the Order Subject can be found in Annex No 1 to SWZ (DETAILS DESCRIPTION DESCRIPTION AND EXPECTIVE DESCRIPTION), constituting Annex 1 to the model contract.

The Contracting Authority informs that as part of task No. 1B, it has applied for a decision on a building permit. The documentation was submitted to the Voivodship Office. The planned date of obtaining a building permit is October 31, 2022.

The contracting authority stipulates that the conclusion of a public procurement contract will take place after obtaining a decision on a building permit.

2. (4.1.1. SWZ) The Contracting Authority provides for the possibility of awarding the contract referred to in Article 388 point 2 letter c) of the Act not exceeding 10% of the value of the basic contract.

As part of the contracts referred to in Article 388 (2) (c) of the Act, the Contracting Authority provides for similar works on the Task provided for under the basic contract. Contracts involving the repetition of similar construction works will be awarded where there is a reasonable need to replicate the construction work on the Task provided for in the framework of the basic contract, in the event of factual or legal obstacles in the implementation of the implementation basic order.

The Contracting Authority shall consider, inter alia, the implementation of an additional dam and discharge assembly together with a section of the gas pipeline, the implementation of additional corrosion protection (active and passive), electrical and lightning systems, implementation of additional switching works, checks and commissions.

3. (3.5. SWZ) In accordance with Article 257(1) of the Act, the Contracting Authority may cancel the procurement procedure if the funds from the budget of the European Union and the unrecoverable funds from the aid granted by the Member States of the European Free Trade Agreement (EFTA), which the Contracting Authority intended to use to finance all or part of the contract, have not been allocated to it.

4. (3.4. SWZ) Ordering Party:

4.1. does not provide for reimbursement of the costs of participation

4.2. does not allow the submission of variant tenders;

4.3. does not provide for the conclusion of a framework agreement;

4.4. does not provide for an electronic auction;

4.5. does not allow the submission of partial tenders;

4.6. informs that if the last day of the deadline for the execution of the activity falls on a Saturday or a statutory day off work, the deadline shall be the next day after the day or days off work [Article 509 (2) of the Act],

4.7. informs that after the signing of the Agreement for the implementation of the task (Main Agreement), an Agreement on the entrustment of the processing of personal data will be concluded — Annex No 12 to SWZ,

4.8. informs that together with the Agreement for the implementation of the task in question (Main Agreement), the Contractor is obliged to sign an obligatory anti-corruption clause – Appendix No. 8 to the Agreement

4.9. informs that it has the status of a large entrepreneur within the meaning of art. 4 point 6) of the Act of 8 March 2013 on counteracting excessive delays in commercial transactions (Journal of Laws of 2019, item 118).
