(1) The subject of the contract are forest management services as defined in Article 6(1)(1) of the Act of 28 September 1991 on forests, including the collection of beech seeds in the amount of 23 500 kg from excluded seed stands (WDN) and economic seed stands (GDN) to be carried out in the Gryfino Forest District in 2022. The subject of the contract also includes the service of transporting the collected seeds to the Seed Storage In Pniewo. A detailed description of the subject of the contract is included in Annex 2 to the SWZ.

(2) The proceedings are conducted in accordance with the rules provided for the so-called "reverse procedure" referred to in Article 139(1), (3) to (4) of the PUBLIC PROCUREMENT LAW.

(3) The Contracting Authority provides for the possibility of awarding contracts referred to in Article 214(1)(PZP).

(2) The material scope of the subject of the contract includes the total quantities of work in the field of seeding, resulting from Annex 2 to the SWZ, which consists of:

(3) The material ranges listed in the Annexes to Annex 2 are estimates.

(4) Quality standards relating to all relevant features of the subject of the contract are specified in Annex 3 to the SWZ, i.e. description of the standard of technology for forestry work, adopted by Decision No. 66 of the Director of the Regional Directorate of State Forests in Szczecin of 06.10.2021 on the introduction of the use of the "Regional description of the standard of technology for the performance of forest works" in organizational units of the State Forests in Szczecin, zn. spr. EZ.011.1.2021 taking into account the changes introduced to the above-mentioned decision.

(5) The number of works indicated in the SWZ falling within the scope of the Subject of the Agreement (valued by the Contractor in the offer estimate constituting part of the Offer) is an estimate. The number of works commissioned to be performed during the implementation of the Subject of the Contract may be less than the number presented in the SWZ, which, however, may not be the basis for any claims of the Contractor against the Ordering Party regardless of their legal basis. The Ordering Party may order during the performance of the Agreement a scope of work smaller than that indicated in the SWZ, but not less than 50% of the Value of the Subject of the Agreement determined in accordance with § 10 sections 1 and 4. In the event of unforeseeable factors such as: very poor quality of seeds due to extreme weather conditions (drought) or weaker actual seed yield than previously assumed, it is possible for the Ordering Party to completely withdraw from the subject of the order or perform the subject of the order in a size smaller than indicated in the preceding sentence. In such a situation, the Ordering Party has determined the fixed costs of spreading and assembling the grids intended for seed harvesting on the area of 1 ha, referred to in §10 of the model contract, constituting Annex 8 to the SWZ.

(6) Pursuant to Article 95 of the Public Procurement Law, the Contracting Authority does not specify the requirements for employment by the Contractor or subcontractor on the basis of the employment relationship of persons performing activities in the field of contract performance.

(7) The Contracting Authority shall allow the Contractor to whom the contract will be awarded to use on the basis of a lease agreement, against payment of rent: Raschel grid for harvesting beech seeds in the amount of 250 000 m2. Model contract - Annex 9 to SWZ

(8) The Contractor may entrust the implementation of elements (parts) of the subject of the contract to subcontractors.

(9) The Contracting Authority is entitled to entrust the Contractor with an additional material scope in relation to the quantity priced in the offer estimate, which is part of the Offer ("Option"). The subject of the Option will be the ZB-NASBK activity (Collection of beech seeds), valued by the Contractor in the offer cost estimate.

(10) The Contracting Authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Public Procurement Law within a period of 3 years from the date of award of the basic contract. Material scope - works in the field of seeding, including activity (ZB-NASBK). The material scope of the services covered by the contracts in question shall not exceed 50 % of the value of this contract. Granting - a separate procedure in the free hand mode.
