Preparation of design documentation for the task entitled: Construction of a bicycle path in Oświęcimska Street

1. The subject of the contract is the preparation of complete and comprehensive design documentation along with the submission of an effective notification of works that do not require a building permit / obtaining a valid (final) building permit / obtaining a legally binding (final) decision for the implementation of a road investment (ZRID) for the task: "Construction of a bicycle path in Oświęcimska Street".

2. A detailed description of the subject matter of the contract is included in Appendix No. 7 to the Terms of Reference.

3. The present procedure is part of a contract announced in separate procedures. The order is not divided into parts, due to the specifics of the order. The project includes the design of a single, coherent section of the bicycle path.

1. The subject of the contract includes the design of a bicycle path with a pavement, for which the outline of the route is presented in Appendix 1. The designed bicycle path with a pavement along Oświęcimska Street (i.e. in the direction from point A to point B according to Appendix No. 1) in the area of point A is to connect with the constructed bicycle path and pavement at Tankistów Street, while in the area of point B, the designed bicycle path and pavement are to connect with the bicycle path and pavement designed along Partyzantów Street. The bicycle path in question, together with the pavement, should be connected at at least two points with the constructed bicycle route running along the Brynica River. The Contracting Authority does not indicate the places and manner of connecting the designed path and pavement with the bicycle path along the Brynica River. The adopted design solutions should ensure free and safe movement for cyclists and pedestrians. The surface of the bicycle path should be designed using the technology of mineral and asphalt mixtures, while the surface of the pavements should be designed of concrete paving stones. A detailed description is provided in Appendix No. 7 to the Terms of Reference.

2. The offer and attachments to the offer should consist of the following files:

1) a completed offer form (Appendix 1 to the specification), i.e. an offer,

2) the statement referred to in Article 125(1) of the Public Procurement Law - ESPD (according to Appendix 2 to the specification),

3) a declaration of non-exclusion pursuant to Article 5k of Regulation 833/2014, as amended by Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (Annex 3 to the specification),

4) a copy or information from the National Court Register, the Central Register and Information on Economic Activity or another relevant register confirming that the person acting on behalf of the contractor is authorised to represent the contractor – if the offer is submitted by a person conducting business activity or an entity entered in the above-mentioned registers. The contractor is not obliged to submit a document if the contracting authority can obtain it using free and publicly available databases, provided that the contractor provides data enabling access to these documents,

and if applicable

5) power of attorney to act on behalf of the contractor, if a person other than the person authorized to represent the contractor is indicated in the document confirming the authorization to represent the contractor,

6) in the case of reliance on the resources of the entity providing the resources, the obligation of the entity providing the resources referred to in Article 118(3) of the PPL,

7) in the case of reliance on the resources of the entity providing the resources – the statement referred to in Article 125(1) of the Public Procurement Law (PPL) of the entity providing the resources,

8) in the case of submission of a bid by contractors jointly applying for the award of the contract – a document confirming the appointment of a representative in accordance with Article 58(2) of the Public Procurement Act,

9) in the case of submission of a bid by contractors jointly applying for the award of the contract – the statement referred to in Article 117(4) of the PPL.

3. In the case of economic operators jointly applying for a contract, the provisions of points 2(2), (3), (4) and (5) shall apply mutatis mutandis.

4. Points 2(4) and (5) shall apply mutatis mutandis to a person acting on behalf of an entity providing resources in accordance with Article 118 of the PPL.

5. Along with the offer, the contractor is obliged to provide a statement of non-exclusion and fulfilment of the conditions for participation in the procedure. The declaration must be made on the form of the Single European Procurement Document (ESPD), drawn up in accordance with the model standard form set out in Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing a standard form for the Single European Procurement Document
