40.1 The Purchaser does not provide:
40.1.1. the conclusion of a framework agreement;
40.1.2. submission of variants and partial tenders;
40.1.3. settlement in foreign currencies;
40.1.4. electronic auction;
40.1.5. reimbursement of the costs of participation in the proceedings;
40.1.6. the requirement or possibility to submit tenders in the form of electronic catalogues
or attach electronic catalogues to the offer;
40.1.7. The Contractor shall carry out an on-site inspection or check by the Contractor the documents necessary for the performance of the contract available on the spot
At the Ordering Party.
40.2 The Ordering Party provides for a right of option pursuant to Article 441 of the PPL – the Ordering Party may exercise the right of option during the term of the contract.
40.2.1 During the term of the contract, the Purchaser may exercise the right of option and increase the number of deliveries made, but not more than:
a) for the City of Łódź – City of Łódź Office 80% of the contract value,
b) for the Social Benefits Centre – 50% of the contract value,
c) for the Lodz Geodesy Centre - 50% of the contract value
d) for the Municipal Social Welfare Center – 100% of the contract value.
40.2.2 The right of option may be exercised if it is necessary to ensure the continuity of deliveries being the subject of the contract, as a result of increased demand for the subject of the order. If the Ordering Party exercises the option right, the settlement of this part of the supplies shall take place using the gross unit prices specified in the annex to the contract, subject to changes in VAT rates. The rights and obligations of the Contractor and the Ordering Party, as well as the rules for settling deliveries resulting from the option right, shall be governed in their entirety by the provisions of the contract. The delivery date resulting from the option right will take place on the terms specified in the Contractor's offer regarding the basic contract
40.2.3 The Purchaser reserves the right to reduce the quantity of ordered goods while reducing up to 30% of the value of the concluded contract. The contractor will be remunerated for the quantity of goods actually ordered and delivered.
40.2.4 The scope of the option right is indicated in the Description of the subject of the contract – Appendix No. 1 to the SWZ and in the contract template – Annex 5 to the SWZ.
40.3 Scope and conditions of amendments to the concluded contract - issues relating to the contract are regulated in the model contract - Annex 5 to the SWZ.
40.4 The Contracting Authority did not conduct preliminary market consultations before initiating the procedure.
