1. The subject of the contract is the delivery of 5 units of mid-class electric buses (10m). 2. The description of the subject of the contract is included in annexes 1A and 1B to the SWZ, as well as in the contract template contained in annex 11 to the SWZ. 3. The contracting authority requires that the share of products, including software used in telecommunications network equipment, originating from Member States of the European Union, countries with which the European Union has concluded agreements on equal treatment of entrepreneurs, or countries to which the provisions of Directive 2014/25/EU are applied by virtue of a Council decision, exceeds 50%. 4. The contractor may entrust the performance of part of the contract to a subcontractor (Article 462 paragraph 1 of the Act). The contracting authority requires that if part of the contract is entrusted to subcontractors, the contractor should indicate in the offer the parts of the contract that they intend to entrust to subcontractors and provide (as far as they are known at this stage) the names (companies) of those subcontractors. Entrusting part of the contract to subcontractors does not relieve the contractor of responsibility for the proper performance of the contract. 5. The contracting authority does not reserve the obligation for the contractor to personally perform key parts of the contract. 6. The contractor referring to equivalent solutions described by the Contracting Authority is obliged to demonstrate that the supplies offered meet the requirements specified by the Contracting Authority. If equivalent solutions are offered, the Contracting Authority requires the Contractor to present documents confirming whether and to what extent in their opinion the equivalence of solutions/products occurs and in what respect (parameters, functions, or characteristics specified by the Contracting Authority) defined in the Description of the Subject of the Contract. 7. If the bidding documentation indicates the origin (brand, trademark, producer, supplier) of materials or equipment or standards, approvals, specifications, and systems referred to in Article 101 of the Act, the contracting authority allows the offering of materials or equipment or equivalent solutions, provided that they ensure obtaining technical parameters no worse than those assumed in the aforementioned documents. The contractor who refers in their offer to equivalent solutions described by the contracting authority is obliged to demonstrate that the materials or equipment offered by them meet the requirements specified by the contracting authority. 8. The contracting authority anticipates the possibility of canceling the procedure if the public funds that were intended to finance the entirety or part of the contract were not awarded to them.
