1.1 Order Type: Services

1.2 Subject of the contract:

order description

• Collection and management of municipal waste directly from properties throughout the city of Orzesze where residents live in the period from 1 April 2024 to 30 April 2025 (in accordance with the annex);

• Collection and management of unsegregated (mixed) municipal waste;

• Collection and management of separately collected municipal waste (paper, glass, metals, plastics, multi-material packaging waste, bio-waste, ash);

• Equipping the property with containers for ash and slag from household furnaces and containers for bio-waste;

• Equipping multi-family and multi-family properties with sets of containers for waste segregation. A full description of the subject of the contract can be found in the Terms of Reference.

1.2 Subject of the contract:

• Collection and management of municipal waste directly from properties throughout the city of Orzesze where residents live in the period from 1 April 2024 to 30 April 2025 (in accordance with the annex);

• Collection and management of unsegregated (mixed) municipal waste;

• Collection and management of separately collected municipal waste (paper, glass, metals, plastics, multi-material packaging waste, bio-waste, ash);

• Equipping the property with containers for ash and slag from household furnaces and containers for bio-waste;

• Equipping multi-family and multi-family properties with sets of containers for waste segregation (paper, glass, metals, plastics, multi-material packaging waste);

• Retrofitting single-family residential properties with bags for separate waste collection (paper, glass, metals, plastics and multi-material packaging waste);

• Collection and management of bulky waste, waste tires and waste electrical and electronic equipment (once a year);

• Collection and management of waste as part of the "Autumn Leaf Collection" campaign in the autumn, including the delivery of waste bags (once a year, maximum number of 120 l bags: 10,000 pcs.)

• Equipping the Selective Municipal Waste Collection Point with containers and waste collection containers;

• Collection and management of waste from the Selective Municipal Waste Collection Point;

• Development and delivery of waste collection schedules for all properties inhabited in the city of Orzesze;

• Providing service to the Selective Municipal Waste Collection Point (PSZOK) in the form of employment of employees.

NOTE: Detailed description of the item of the order is Annex 2 to SWZ

1.4. Evidence in question: The Contracting Authority does not require the submission of such evidence in the present proceedings.

1.5. The Contracting Authority does not require the Contractor to carry out a site visit or to check the documents necessary for the performance of the contract referred to in Article 131(2) of the Act.

1.6 . A contractor, subcontractor, or further subcontractor performing activities related to the performance of the contract is obliged to employ persons under an employment contract, i.e. persons performing activities under this contract, where the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974. Labour Code (consolidated text: Journal of Laws of 2020, item 1320). The Contractor is obliged to ensure that subcontractors and subcontractors also meet all the requirements for persons employed under a contract of employment. The requirement of employment under an employment contract applies to persons who perform activities directly related to the performance of the service, i.e. collection of municipal waste (drivers and persons involved in loading waste), as well as persons supervising the performance of the contract as well as managing and disposing of the vehicle fleet.

Therefore, the requirement does not apply to, among others, the following persons: construction managers, transport services, surveyors, suppliers of construction materials, equipment, devices, natural persons conducting business activity, incumbent members of the management or supervisory bodies of the Contractor, partners in a general partnership or partnership to the extent that they will personally perform works for the Contracting Authority or the Contractor.

The method of verification of the employment of persons, the control of the contractor's compliance with the requirements related to employment, and the sanctions for failure to meet these requirements are described in the Draft Provisions of the Agreement, which are attached to the Terms of Reference.
