The subject of the contract are services related to winter maintenance of road cleanliness on the streets of the city of Opole in the winter season 2023/2024, which should be understood as the time from October 1 to April 30.
The scope of the contract includes:
a) snow removal of streets,
b) elimination of slipperiness on the streets,
c) cleaning the roadway in terms of scooping snow, ice, slush,
d) installation and dismantling of snow fence,
(e) snow removal.
The subject of the contract are services related to winter maintenance of road cleanliness on the streets of the city of Opole in the winter season 2023/2024, which should be understood as the time from October 1 to April 30.
The scope of the contract includes:
a) snow removal of streets,

(e) snow removal.
The scope of services provided regarding the winter cleaning of the roadway on the streets of the city of Opole will depend on the weather conditions and the financial resources allocated for this purpose.
For the purposes of this order, the Ordering Party introduces the following deadlines for the service:
Period No. I - from October 01 to December 19.
Period No. II - from December 20 to February 20.
Period No. III - from February 21 to April 30.
A detailed description of the subject of the contract includes:

In the course of performance of the contract, the Contracting Authority provides for the right of option referred to in Art. 441(1) of the Public Procurement Act, consisting in the provision of services consistent with the subject of the contract by the contractor under the same conditions specified in the contract, in the case of performance of the contract for the amount specified in § 3(1) of the contract annexed to the proceedings in question before the expiry of the deadline specified in §2(1) of the contract. It is planned to increase the scope of the contract to 30% of the value of the basic contract specified in the description of the subject of the contract and in the cost estimates. The contracting authority makes the exercise of the option right dependent on the weather conditions and the possession of financial resources. The right of option is a right of the Ordering Party that may or may not be exercised. If the Ordering Party does not exercise the option right, the Contractor shall not be entitled to any claims. The condition for activating the option right is the submission by the Ordering Party of a declaration of will regarding the exercise of the option right in the scope specified by him, in writing under pain of nullity. Performance of the contract under the right of option may take place on the date of performance of the contract annexed to the present proceedings and specified in §2(1) of that contract. All requirements contained in this contract and the description of the subject of the contract also apply to the execution of the order under the right of option. The exercise of the right of option does not constitute a modification of the contract or the conclusion of an additional contract under new conditions.
