The subject of the contract is the delivery, implementation, configuration, commissioning and warranty service of the File Storage and Sharing System (NAS), in accordance with the guidelines of the Ordering Party. The order includes:
1. Delivery of two independent NAS Systems with software enabling the use of the Solution in a manner consistent with the requirements of the Ordering Party along with the installation (description of the requirements contained in point 5 of the OPZ),
2. Installation and start-up of the Solution,
3. Configuration of the delivered system in accordance with the guidelines of the Ordering Party,
4. Provision of warranty services for the delivered system,
5. Training of the Ordering Party's administrators in the use of the implemented Solution,
6. Delivery of as-built documentation as described in point 9 of the OPZ.
General conditions for supplied equipment
1. Devices must be brand new (i.e. manufactured no earlier than 6 months before delivery) and not in use. Refurbished, demonstration or post-exhibition equipment is not allowed.
2. All equipment supplied must come from the authorised sales channel of the manufacturers of the equipment offered. At the request of the Ordering Party, the Contractor must provide a statement of the manufacturer of the offered device, confirming the origin of the device from the manufacturer's official distribution channel.
3. Devices with a legal defect in terms of equipment origin, technical support and manufacturer's warranty are not allowed.
4. The Contractor ensures and undertakes that the use of the delivered products by the Ordering Party will not constitute a violation of copyrights of third parties. In case of doubts as to the compliance of the offered products with the description of the subject of the contract, in particular in the scope of software legality, the Ordering Party is entitled to:
4.1. ask the manufacturer of the offered products to confirm their conformity (including providing the manufacturer with the necessary data enabling verification), and
4.2. instruct the manufacturer of the offered products, or an entity designated by the manufacturer, to inspect the products in terms of their compliance and the validity and scope of license rights.
5. If the inspection referred to in point 3.4.2 above shows non-compliance of the products with the description of the subject of the contract or finds that the use of the products violates the manufacturer's economic copyrights, the cost of the inspection shall be covered by the Contractor, according to the bill presented by the entity performing the inspection, in the amount not exceeding 30% of the contract value (this limitation does not apply to the costs incurred by the Ordering Party as a result of the inspection, such as the need to buy new software). The right to order an inspection does not limit or exclude other rights of the Ordering Party, in particular the right to demand delivery of products in accordance with the contract and claims for damages.
6. The equipment offered on the day of submission of tenders may not be put into operation by the manufacturer.
7. All equipment that requires it must bear the CE marking (Conformité Européenne) of the product or meet equivalent standards.
8. Equipment must be manufactured in accordance with ISO-9001 or later or equivalent standards.
9. All devices must work with the following parameters: 230 V ± 10%, 50 Hz., single-phase and be equipped with power cords.
10. All offered devices (which require it) must operate under the control of software, which is a public version, made available on the market by the manufacturer of the offered devices. The Ordering Party does not allow the use of dedicated software, created for the needs of this order, for the offered devices.
11. All devices offered must be publicly available. The Ordering Party does not allow the use of dedicated devices created for the needs of this order.
12. All supplied SFP/SFP+/SFP28 inserts, etc., must be certified by the device manufacturer and must be serviced by the device manufacturer.
13. All work in the server room must take place in variable footwear or shoe protectors that will ensure cleanliness in the above-mentioned room.
