4.1. The subject of this contract is the provision of municipal waste management services, including waste collected at the Selective Municipal Waste Collection Point (PSZOK) from the area of the Łyse Commune, in a manner ensuring the achievement of appropriate levels of recycling, preparation for re-use and recovery by other methods and limiting the weight of biodegradable municipal waste sent to landfill, in accordance with the provisions of the Act of 13 September 1996 on maintenance cleanliness and order in municipalities (i.e. Journal of Laws of 2022, item 2519, as amended), the locally applicable waste management plan and the provisions of the draft Regulations for maintaining cleanliness and order in the Łyse Commune.
4.1. 4.3. The scope of the contract includes municipal waste management in 2024 and 2025, divided into the following fractions:
1. non-segregated (mixed) municipal waste mixed with ash with code 20 03 01 in an estimated amount of approx. 1860.00 Mg;
2. biodegradable waste with codes 20 02 01, 20 01 08 in an estimated amount of approx. 150.00 Mg;
3. paper and cardboard, paper and cardboard packaging of codes 20 01 01, 15 01 01 in an estimated amount of approximately 20,00 Mg;
4. plastics, plastic packaging codes 15 01 02, 20 01 39 in an estimated amount of approx. 205.00 Mg;
5. metals, metal packaging codes 15 01 04, 20 01 40 in an estimated amount of approx. 2.00 Mg;
6. Glass packs of glass with codes 20 01 02, 15 01 07 in an estimated quantity of approximately 156,00 Mg.
7. bulky waste with code 20 03 07 in an estimated amount of approx. 150.00 Mg,
8. waste electrical and electronic equipment with codes 20 01 36, 20 01 35* in an estimated amount of approx. 10.00 Mg.
4.4. How to provide the service:
4.4.1. In the case of processing mixed municipal waste, green waste and other bio-waste, the Contractor should have the status of a municipal installation in accordance with applicable law, including in particular in accordance with the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2022, item 2519, as amended) for: mechanical and biological waste treatment installations, biological treatment installations for biodegradable waste, storage of waste generated in the mechanical and biological treatment of mixed municipal waste and residues from waste sorting. Treatment of waste collected in a selective manner, including packaging waste, may not be carried out outside the installations and devices of Article 30 paragraph 1 of the Act of 14 December 2012 on waste (Journal of Laws of 2022, item 699, as amended), however, these installations do not have to have the status of a regional installation.
4.4.2. Waste management is to be confirmed by a waste transfer card (understood in accordance with the Regulation of the Minister of the Environment of 25/04/2019 on the templates of documents used for the needs of waste records (Journal of Laws of 2019, item 819), hereinafter referred to as the "Waste Transfer Card"), provided to the Ordering Party together with the VAT invoice for the month to which the card relates. The data from the card must be in accordance with the weight receipts, confirming the time and weight of municipal waste accepted into the installation.
4.4.3. The estimated amounts of municipal waste indicated in the SWZ constitute the expected amount of municipal waste to be transferred in 2024 and 2025. The Ordering Party reserves the right to reduce or increase the amount of waste transferred in relation to those indicated in point 4.3. In such a situation, the contractor is obliged to manage a smaller or larger amount of waste of a given type at the unit prices indicated in the offer.
