The subject of the contract are successive deliveries of 4 379 048 pcs. toilet paper for prisoners, the detailed description of which is attached as Annex 1 to the draft agreement, for the benefit of organizational units of the Prison Service, under the conditions specified in the draft agreement constituting Annex 1 to the SWZ.

Minimum requirements:
Dimensions and weight of the roll:
a) width – not less than 95 mm;
b) length – not less than 40 m;
(c) weight – not less than 150 g;
d) inner diameter of the sleeve – not less than 30 mm;
e) weight of the sleeve – not more than 7 g.
Physical properties:
a) weight – not less than 30 g/m2;
b) humidity – not more than 9%.
Other requirements:
(a) natural or pastel colour;
(b) the paper should be soft, disintegrating on contact with water;
c) paper damage such as holes, tears, creases are unacceptable
and tears and unevenness of the roller faces;
d) the subject of the contract must not contain impurities in the form of sand, carbon particles and other components affecting the performance of the paper;
(e) 64 rolls of paper shall be packed in bulk packaging made of plastic.
1. SAMPLES
1) In order to confirm that the offered subject of the contract meets the requirements specified by the Ordering Party, the Ordering Party shall submit within the time limit specified in point XIX.2. SWZ, samples in the form of 5 rolls of offered toilet paper.
2) Samples should be handed over to the Ordering Party via a postal operator within the meaning of the Act of 23 November 2012 – Postal Law (i.e. Journal of Laws of 2022, item 896), in person or through a messenger.
3. Samples should be packaged and protected in such a way as to guarantee preservation
confidentiality of the contents of the package and allowing the integrity of the samples to be preserved
until the deadline for opening tenders. The packaging should bear the name and address of the Contractor and the name and address of the Ordering Party: Central Board of the Prison Service, Quartermaster and Investment Office, Rakowiecka 37A, 02-521 Warsaw, with the note: "Samples, case sign: 9/23/KS".
4) The contractor handing over the samples in person will receive a confirmation of their delivery, including the date of their submission and the case mark appearing on the packaging.
5) Pursuant to Article 107(3) of the Act, samples shall not be submitted or supplemented at the request of the Contracting Authority referred to in Article 107(2) of the Act.
Therefore, no submission of samples or submission of samples in quantities less than specified
in point 1) above, will result in rejection of the offer pursuant to Article 226 paragraph 1 point 5).
Grounds for exclusion:
1. The Contracting Authority shall exclude the Contractor from the proceedings in the circumstances referred to in Article 108(1) of the Act.
2. The Contracting Authority shall exclude the Contractor from the proceedings in the circumstances referred to in Article 7(1) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and for the protection of national security.
3. The Contracting Authority shall exclude the Contractor from the proceedings in the circumstances referred to in Article 109(1)(1)-(4) of the Act.
4. The Contracting Authority shall exclude the Contractor from the proceedings in the circumstances referred to in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in connection with Russia's actions destabilising the situation in Ukraine.
Deposit:
The Contractor is obliged to pay a deposit in the amount of PLN 63,000.00. (sixty-three thousand zlotys 00/100).
