The subject of the public procurement is the service of conducting a maximum of 210 training sessions on "Learning Programming and Building Educational Robots" and the preparation of a set of training materials for trainers conducting training in the form of, among others, e-presentations and for participants in the form of e-scripts and video materials, including:
1) Development of a detailed training program "Learning Programming and Building Educational Robots" based on the attached framework program along with the distribution of teaching materials for this program;
2) Development of a detailed training program mentioned in point 1) a set of training materials for trainers conducting training in the form of, among others, e-presentations and for participants in the form of e-scripts and training video material - a 10-hour training video;
3) Conducting training for a maximum of 210 training groups based on points 1) and 2);
4) Conducting a test developed by the Contractor to verify the knowledge acquired by participants during the training in each training group.
The Ordering Party reserves the right to conduct training for no less than 175 groups. In such a case, the Contractor will not submit any claims related to the limitation of the subject of the contract.

Supplementing the description of the subject of the procurement are the provisions of the draft contract regarding the public procurement.
The Ordering Party requires the Contractor to take care of the natural environment, by, among others, eliminating the use of disposable items made of plastics, refraining from using disposable packaging, bags, nets, and plastic bags made of polyolefin plastics, utilizing materials for the performance of the contract that are from recycling or subject to the recycling process, etc.

This proceeding is conducted in the mode of an open tender based on the Act of September 11, 2019, Public Procurement Law, hereinafter referred to as the "p.z.p. Act" or "p.z.p.", taking into account the provisions of Section IV, Chapter 4 of the p.z.p. Act - Procurement for social services and other particular services and this Specification of Procurement Conditions, hereinafter referred to as "SWZ".
The estimated value of the contract exceeds the amount specified in the announcement of the President of the Public Procurement Office issued under Article 3, Paragraph 2 of the p.z.p. Act.
The Ordering Party provides for the application of the so-called reverse procedure, referred to in Article 139, Paragraph 1 of the p.z.p. Act, i.e. the Ordering Party will first assess and evaluate the offers and then qualify the Contractor whose offer has been evaluated the highest regarding the lack of grounds for exclusion and the fulfillment of the conditions for participation in the proceedings.
The Ordering Party indicates that this procurement process is one of the contracts covered by separate procedures.
However, the subject of this procurement, due to its type, scope, specificity, degree of complexity, and planned implementation method requires consistency. The subject procurement is indivisible. For technological and execution reasons as well as for rational public expenditure, it cannot be divided into parts. This would risk obtaining different qualities of services that are the subject of the procurement as well as the need to coordinate the actions of different contractors carrying out individual parts of the contract. Additionally, there would be a risk of non-performance of part of the contract. Furthermore, according to the knowledge of the Ordering Party, such contracts are handled by specialized companies. It is also worth noting that the lack of division of the contract into parts does not negatively affect the competitiveness of the proceedings due to the significant number of entities on the market capable of fulfilling the goals and intentions of the Ordering Party by entrusting them with the execution of the entire undertaking without artificially dividing it into smaller elements.
Therefore, in making the decision not to divide the contract into parts, the Ordering Party considered the economic efficiency of the awarded contract in order to properly balance the two issues: on one hand, dividing contracts into parts to facilitate the participation of small and medium-sized enterprises in the proceedings, and on the other hand - minimizing its administrative burdens by commissioning the execution of the contract to a single contractor who will be responsible for performing all tasks.
In consideration of the above, it should also be noted that according to the content of recital 78 of Directive 2014/24/EU, the contracting authority should be obliged to consider the purpose of dividing contracts into parts, while maintaining the autonomy to make decisions on any basis it considers appropriate, not subject to administrative or judicial oversight.
Requirements regarding accessibility for people with disabilities in accordance with Article 100, Paragraph 1 of the p.z.p. Act - the scope of the anticipated services, contained in the description of the subject of the procurement, takes into account the accessibility criteria for people with disabilities. The description of the subject of the procurement does not discriminate against any social groups.
The Ordering Party does not allow the submission of variant offers or in the form of electronic catalogs.
The Ordering Party is not conducting proceedings for the conclusion of a framework agreement.
The Ordering Party does not reserve the possibility of applying for the award of the contract solely by the contractors referred to in Article 94 of the p.z.p. Act.
