1. The subject of the order is the purchase of medical equipment for Copernicus PL Sp. z o.o. (endoscopic vision systems, video gastroscopes, video colonoscopes, video duodenoscopes, tympanometry). 2. The subject of the order has been divided into two parts: Part 1: Endoscopic vision system, Video gastroscopes, Video colonoscopes, Video duodenoscopes: Task No. 1: Endoscopic vision system, Task No. 2: Video gastroscope type I, Task No. 3: Video gastroscope type II, Task No. 4: Video gastroscope type III, Task No. 5: Video colonoscope type I, Task No. 6: Video colonoscope type II, Task No. 7: Video duodenoscopes type I. Part 2: Tympanometry: Task No. 1: Tympanometer type I, Task No. 2: Tympanometer type II. 3. A detailed description of the subject of the order specifying the requirements of the Ordering Party and quantities is contained in Annex No. 3 to the SWZ - Description of the Subject of the Order. The Contractor, filling in the indicated positions in this annex, confirms the fulfillment of the requirements specified by the Ordering Party. 4. The manner of execution of the subject of the order is specified in the draft agreements - Annex No. 6a (successive deliveries) 6b (one-time delivery) to the SWZ. 5. The offered items of the order must be complete, of high quality standards in terms of both quality and functionality, and free from material, construction, and legal defects. 6. The offered items of the order must be approved for circulation and use in accordance with applicable law regulations. 7. The subject of the order must comply with the Act of April 7, 2022, on medical devices (Journal of Laws 2022.974 of May 9, 2022), if the Ordering Party requires the offer of an assortment that constitutes a medical device. 8. In all provisions of the SWZ and its annexes, where the Ordering Party refers to standards, approvals, technical specifications or reference systems or indicates trademarks, parameters or sources of origin (names of manufacturers or devices), in accordance with Article 99(5) and Article 101(4) of the Public Procurement Law, the Ordering Party allows equivalent solutions. 9. The Ordering Party does not reserve the possibility of applying for the order solely by Contractors mentioned in Article 94 of the Public Procurement Law. 10. The source of financing for the public procurement: (applying to part No. 1 and part No. 2) Project name within the National Reconstruction and Resilience Plan: Achieving access to the highest quality cancer therapies and diagnostics through the purchase of equipment for COPERNICUS Podmiot Leczniczy Sp. z o.o. in Gdańsk. Component D “Efficiency, accessibility, and quality of the health care system”. Investment D1.1.1. “Development and modernization of the infrastructure of high-specialization care centers and other healthcare entities”. The amount of VAT is not an eligible expense within the aforementioned project, and the Ordering Party will finance this amount from its own funds, (applies to part No. 1 task No. 1) – purchase planned as part of co-financing from the Gdańsk City Municipality. 11. The Ordering Party reserves the right to annul the procurement procedure if the funds from the grant referred to above, which the Ordering Party intended to allocate for financing the order, are not granted to them. 12. In accordance with the principles of the aforementioned project, the Ordering Party informs that this procedure (including the assortment/equipment being its subject) will be assessed for compliance with the DNSH principle. This means not supporting or engaging in economic activities that cause significant harm (serious harm that has a significant negative impact) to any of the environmental objectives. The DNSH principle (Do No Significant Harm) results from the regulation of the European Parliament and Council (EU) 2020/852 of June 18, 2020, on establishing a framework for facilitating sustainable investments, known as Taxonomy. Therefore, each undertaking financed under the National Reconstruction Plan is subject to an assessment regarding “doing no significant harm” - DNSH. 13. Contractors who meet the conditions for participation in the procedure and who are not excluded from the procedure due to one of the circumstances indicated: - in Article 108(1) of the Public Procurement Law, which occurred in the relevant period specified in Article 111 of the Public Procurement Law - in Article 7(1) of the Act of April 13, 2022, on special solutions for preventing support for aggression against Ukraine and serving to protect national security. - in Article 5k(1) of the Council Regulation (EU) 2022/576 of April 8, 2022, amending Regulation (EU) No. 833/2014 regarding restrictive measures related to actions by Russia destabilizing the situation in Ukraine. - in Article 1(1) of the Implementing Regulation of the Commission (EU) 2025/1197 of June 19, 2025, imposing a measure of the International Procurement Instrument restricting access of suppliers and medical devices from the People’s Republic of China to the EU public procurement market for medical devices in accordance with the regulation of the European Parliament and Council (EU) 2022/1031 (hereinafter referred to as: regulation 2025/1197) The Ordering Party also plans to exclude the Contractor in the event that circumstances arise referred to in Article 109(1)(2)(a), (b), (c), and (3) of the Public Procurement Law, i.e., who violated obligations in the field of environmental protection, social law, or labor law. 14. The Ordering Party, before choosing the most advantageous offer, will invite the Contractor whose offer was rated the highest to submit, within a specified period of no less than 10 days, current at the time of submission of the subjective means of proof described in § X of the SWZ. 15. The Ordering Party does not require the submission of subjective means of proof along with the offer in accordance with paragraph VII of the SWZ. 16. The Ordering Party does not demand from the Contractor a performance bond. 17. A condition for participation in the public procurement procedure is the submission of a bid security in the appropriate amount.
