DESCRIPTION:
1. The subject of the order includes the delivery and implementation of a mobile system for the detection and neutralization of Unmanned Aerial Vehicles (UAVs).
2. A detailed description of the subject of the order regarding the base vehicle is included in Annex No. 2 to the SWZ.
3. A detailed description of the subject of the order regarding the installation and the system for the detection and neutralization of Unmanned Aerial Vehicles (UAVs) is included in Annex No. 3 to the SWZ.
4. Warranty conditions:
4.1. The required minimum warranty period for mechanical, electrical, and electronic components of the vehicle where the installation was made is 24 months with no mileage limits.
4.2. The required minimum warranty period for the paint coating of the vehicle where the installation was made is 24 months.
4.3. The required warranty period for perforation of the body elements of the vehicle, where the installation was made, is 72 months.
4.4. The required minimum warranty period for the installation and equipment, including the system for the detection and neutralization of Unmanned Aerial Vehicles (UAVs), is 24 months.
4.5. The start of the warranty period will be counted from the date of acceptance of the subject of the order.
4.6. Updates for the Command and Control software (hereinafter: “C2 Software”) must occur at least once a quarter.
INFORMATION ON RESTRICTED ACCESS TO PARTS OF THE SWZ:
1. Based on Article 133 (3) in conjunction with Article 18 (2) of the Public Procurement Law, the Purchaser restricts access to Annex No. 3 and Annex No. 4 to the SWZ, due to the need to protect the confidential information contained therein.
2. The access to Annex No. 3 and Annex No. 4 to the SWZ will occur under the following principles:
2.1. In order to obtain access to Annex No. 3 and Annex No. 4 to the SWZ, the Contractor will be required to submit a request according to the template that constitutes Annex No. 8 to the SWZ.
2.2. The request must be signed with a qualified electronic signature of the person(s) authorized to represent the Contractor.
2.3. The request must include a document proving authorization to represent the Contractor (e.g., a current excerpt from the KRS, power of attorney). The form of documents confirming the authorization should comply with the principles resulting from the Regulation of the Prime Minister of December 30, 2020, regarding the manner of preparing and transmitting information and technical requirements for electronic documents and electronic means of communication in public procurement or competition proceedings.
2.4. The request must include a confidentiality agreement signed by the person(s) authorized to represent the Contractor in accordance with Annex No. 9 to the SWZ.
2.5. If the request is incomplete or contains errors, the Purchaser will call upon the contractor to complete it within 3 days from the date of notification. Failure to complete or incorrectly completing the request will result in it being left unexamined.

2.7. Access to Annex No. 3 and Annex No. 4 to the SWZ will occur to the email address specified in the request. The Purchaser will send a password-protected file containing Annex No. 3 and Annex No. 4 to the SWZ. The password to access Annex No. 3 and Annex No. 4 to the SWZ will be sent by SMS to the mobile phone number provided in the request.
2.8. The Purchaser will not provide Annex No. 3 and Annex No. 4 to the SWZ to a Contractor that falls under any exclusion described in Chapter I, paragraph 18 of the SWZ.
ORDERS REFERRED TO IN ARTICLE 214 (1) (8) OF THE P_PL LAW:
The Purchaser does not foresee granting orders based on Article 214 (1) (8) of the Public Procurement Law.
EXECUTION DEADLINE:
The execution period for the subject of the contract is 8 months from the date of concluding the contract.
The Contractor will grant a perpetual non-exclusive license for the C2 Software.
PROTECTION OF PERSONAL DATA COLLECTED BY THE PURCHASER DURING THE PROCEDURE:
Information on personal data protection can be found in Chapter I, paragraph 17 of the Terms of Reference [hereinafter: SWZ].
GROUNDS FOR EXCLUSION:
1. Contractors who are not subject to exclusion may apply for the award of the contract.
2. The Purchaser will exclude from the proceedings Contractors who meet the grounds for exclusion referred to in:
- Article 108 (1) of the Public Procurement Law,
- Article 7 (1) of the act of April 13, 2022, on special solutions for preventing support for aggression against Ukraine and ensuring national security,
- Article 5k of the Council Regulation (EU) No 833/2014 of July 31, 2014, concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine (OJ EU L 229 of July 31, 2014, p. 1), hereinafter: Regulation 833/2014, as amended by the Council Regulation (EU) 2025/2033 regarding the amendment of Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine (OJ EU L 111 of April 8, 2022, p. 1).
3. Exclusion occurs during the duration of the circumstances specified in Chapter III, paragraph 2.3. of the SWZ.
4. In the case of a Contractor excluded on the grounds specified in Chapter III, paragraphs 2.3. – 2.4. of the SWZ, the Purchaser rejects such Contractor's offer.
5. A person or entity subject to exclusion on the grounds specified in Chapter III, paragraph 2.3. of the SWZ, who, during this exclusion, applies for public procurement or participates in the public procurement procedure or in a competition, is subject to a monetary penalty.

CONDITIONS FOR PARTICIPATION IN THE PROCEDURE:
1. Contractors may apply for the award of the contract who:
1.1. are not subject to exclusion,
1.2. meet the conditions for participation in the procedure, if specified.
2. Based on Article 112 of the Public Procurement Law, the Purchaser specifies the conditions for participation in the proceedings concerning:
2.1. ability to operate in the economic turnover – the Purchaser does not formulate a condition for participation in the procedure in this regard;
2.2. authorizations to conduct a specific business or professional activity, if necessary from separate regulations – the Purchaser does not formulate a condition for participation in the procedure in this regard;
2.3. economic or financial situation – the Purchaser considers that the Contractor meets the requirement regarding economic situation if the Contractor demonstrates that they have:
2.3.1. financial resources or creditworthiness in the amount not less than 2,500,000.00 PLN (in words: two million five hundred thousand zlotys);
2.3.2. appropriate civil liability insurance regarding the work conducted related to the subject of the order with a guarantee sum of no less than: 2,500,000.00 PLN (in words: two million five hundred thousand zlotys).
In the case of Contractors jointly applying for the award of the contract, the condition regarding the economic situation described in point 1.2.3. can be met collectively by all Contractors. However, each of the conditions described in points 1.2.3.1 and 1.2.3.2 must be met in full by at least one of the Contractors jointly applying for the award of the contract. The Purchaser does not allow the possibility of summing or dividing amounts between Contractors jointly applying for the award of the contract concerning the conditions described correspondingly in points 1.2.3.1 and 1.2.3.2.
2.4. technical or professional ability – the Purchaser will recognize that the Contractor meets the requirement regarding technical or professional ability if the Contractor demonstrates that they have duly completed within the last five years one delivery of a value not less than 2,500,000.00 PLN gross regarding the implementation of a system for the detection and non-kinetic neutralization of Unmanned Aerial Vehicles (UAVs).
INFORMATION ON THE SUBJECT وسائل الدليل:
1. The Purchaser requires that the Contractor submit the following subject means of evidence along with the offer:
− Technical specification of the offered subject of the order drawn up according to the template constituting Annex No. 4 to the SWZ.
2. The Purchaser anticipates the supplementation of the subject means of evidence, if the Contractor did not submit them or submitted incomplete subject means of evidence.
EXPLANATION OF FIELD BT-536-Lot:
The indicated date in this field - January 20, 2025, is entirely indicative, and the deadline for order completion is 8 months from the date of contract conclusion. The Contractor will grant a perpetual non-exclusive license for the C2 Software.
