The present proceedings are not subject to public procurement law. It is a so-called open-house procedure. Within the framework of this procedure, the AOK Baden-Württemberg pursues the goal of voluntarily entering into agreements with all suitable companies for the assumption of additional costs for blood sugar test strips of price groups 2 and 3 of Annex 5.4 to the Baden-Württemberg Medicinal Contract (AVV) versus costs for blood glucose test strips of price group 1 Annex 5.4 to the GCU. The contract period starts at the earliest on 1.2.2020 and amounts to a maximum of 48 months. It ends no later than 31.1.2024. A contract is possible within the period from 1.2.2020 to 1.1.2024 at any time to the first of the month. The subject of the present public procurement-free open-house procedure is the conclusion of non-exclusive agreements for the assumption of additional costs for blood sugar test strips of price groups 2 and 3 of Annex 5.4 to the AVV, which are handed over during the contract period and charged to the insured person at the expense of the AOK Baden-Württemberg. Württemberg, compared to the costs for blood glucose test strips of price group 1 of Annex 5.4 to the AVV in the currently valid version. Subject of this agreement are not blood glucose test strips that are prescribed as part of consultation hours. The subject of the agreement are all blood glucose test strips which can be assigned to price groups 2 and 3 of Annex 5.4 to the AVV and which are placed on the market by the contractual partner of AOK Baden-Württemberg during the contract period.
The participation is open to all companies domiciled in or in a Member State of the EU or EEA who place prescribable blood glucose test strips of price groups 2 and 3 of Appendix 5.4 to the AVV in Germany.
Individual negotiations on contract contents are not conducted, uniform conditions apply. The AOK Baden-Württemberg does not guarantee the contract partners exclusivity.
The beginning of the contract can only be one month first. The offer must reach the AOK electronically via the allocation platform or e-mail by 16/12/2019 and then within 3 working days after the expiry of the deadline, twice in the original with the AOK, so that a contract start on 1.2.2020 comes into consideration. For a contract beginning after 1.2.2020, the contract documents should be submitted electronically 4 weeks before the intended start of the contract and then within 3 working days after expiry of the deadline twice in the original at the AOK. Closing date for submission of tenders is 4.12.2023 for a contract on 1.1.2024. All closed contracts end no later than 31.1.2024.
