The subject of this contract is the EXECUTION OF A COMPREHENSIVE SUPPLY OF HIGH-METHANE NATURAL GAS TYPE E FOR THE NEEDS OF THE PIŃCZÓW POVIAT AND ITS ORGANIZATIONAL UNITS for the facilities indicated in Annex 1 to SWZ. Order – comprehensive supply of natural gas to the facilities listed in Annex 1 to the SWZ: The estimated demand for natural gas in the period from 01.01.2023 to 31.12.2023 is 4 237 817.00 kWh.
The subject matter of this order is the EXECUTION of a COMPLEXICAL DELIVERY GASE HIGHT TYPE E FOR PIŃCZOWSKA RELATION AND ONE ORGANISATION FOR objects indicated in Annex 1 to SWZ. The supply of gas will be carried out on the basis of a contract containing the provisions of the sales contract and the contract for the provision of gas transmission or distribution services (a comprehensive contract) and will be carried out in accordance with the provisions of the Energy Law, the Civil Code and the implementing rules issued on the basis of them.
The Pińczów County and the units listed in Annex 1 to the SWZ will conclude separate contracts resulting from this public procurement procedure under the unlimited tender procedure for the EXECUTION OF A COMPREHENSIVE SUPPLY OF HIGH-METHANE NATURAL GAS TYPE E FOR THE NEEDS OF THE PIŃCZÓW POVIAT AND ITS ORGANIZATIONAL UNITS. Detailed information on the conclusion of contracts by the Commune and its organizational units is included in Annex 1 to SWZ.
2. The Contracting Authority shall act on his own behalf and on the basis of the signed Agreement (Agreement for inspection at the office of the Contracting Authority), on behalf of:
• Social Assistance House in Pińczowo
• County Road Management Board in Pińczowo
• Hugon Kołłątaj High School in Pińczów
• Special School and Education Centre in Pińczów
• Vocational School Team in Pińczowo
• Health Care Team in Pińczowo
• District Cultural Center for Tourism and Recreation Sports in Pińczowo
As well as their organizational units, which are indicated in Annex 1 to the SWZ.
Order — Comprehensive supply of natural gas to the facilities listed in Annex 1 to SWZ:
1) The estimated demand for natural gas in the period from 01.01.2023 to 31.12.2023 is 4 237 817.00 kWh. The costs of using the subject of the contract in the above-mentioned period consist of: a fee for the sale of gas, a subscription fee, a fixed distribution fee and a variable distribution fee.
2) The costs incurred throughout the entire period of using the subject of the contract do not include possible fees for exceeding the Contractual Capacity, fees for non-compliance by the Ordering Party with the restrictions introduced by the Distribution System Operator, and other additional fees set out in the Distribution System Operator Tariff, Instructions for Operation and Operation of the Distribution Network, which applies to both all Contractors and Ordering Parties (sellers and recipients), on the terms resulting from the tariff of the Distribution System Operator, instructions for operation and operation of the Distribution Network.
4. The Ordering Party informs that the process of changing the seller takes place once again. Detailed information is contained in Annex 1 to SWZ.
5. The Ordering Party does not require the submission of the means of proof in question.
6. The Ordering Party in the Detailed Description of the Subject of the Order (Annex No. 1 to THE SWZ) indicated in the case of which gas collection points and in what part individual customers will benefit from tariff protection in accordance with the Act on special solutions for the protection of gas fuel customers in connection with the situation on the gas market (Journal of Laws of 2022, item 202). Appendix No. 11 to the SWZ contains copies of the Statements on the purpose of gaseous fuel.
