Pursuant to Article 95(1) of the Public Procurement Law, the Contracting Authority requires that persons performing the activities specified in the Terms of Reference in the scope of contract performance, the performance of which consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – the Labour Code (Journal of Laws of 2023, item 1465), be employed by the Contractor or subcontractor on the basis of an employment relationship.
The contractor or subcontractor shall employ the above-mentioned persons for the duration of the contract. In the event of termination of the employment relationship before the end of this period, he undertakes to immediately employ another person in his place.
