Licenses and hardware for speech recognition software "Dragon Medical Direct" (DMD)

The subject of this tender is the purchase of licenses for the use of the speech recognition software "Dragon Medical Direct" (DMD), the associated microphones for dictation, the instruction of key users in the user interface and 36 months maintenance of the software licenses. The above-mentioned components are already used in large quantities (350 pieces) in all Knappschaft clinics. As part of the KHZG applications from the Hospital Future Act (KHZG), an additional need for around 500 additional licenses for the next 3 years was determined. Unit prices are queried for the listed requirements. The quantities indicated are a quantity based on the KHZG applications. Billing is based on the quantities actually ordered after the award. A minimum purchase or quantitative limit is not specified. The actual limitation results from the limitation of the bodies authorised to call.

All clients have submitted applications to KHZG to promote procurement. The awarding authority, contact point is Knappschaft Kliniken Service GmbH. KKSG concludes the contract on behalf of the client. In addition, if required, and the following companies should be authorized clients:

Currently, companies are being founded in the network of the Knappschaft Kliniken, which take over tasks from the network. These companies are also entitled to call on as soon as they are established. The following are planned:

The companies entitled to call are clients and invoice recipients for their respective needs. The clients are not jointly and severally liable. Orders are carried out directly by the clients. Billing and delivery addresses are specified by the respective customer when ordering. The billing and delivery addresses will be changed/supplemented by the contractor free of charge if necessary. The place of performance is at the respective customer or at the delivery address specified in the individual order. Delivery is free of charge.

The framework agreement has a term of 12 months from the award. The framework agreement is extended three times by 12 months each if it is not terminated by the client 3 months before the end of the respective term. After expiry of the contract period of 48 months, the contract can in principle be extended by mutual agreement for one year at a time. Retrievals can be made up to the last day of the term. The term of software maintenance amounts to 36 months in each case and can thus exceed the term of the framework agreement.

The prices in the price sheet are fixed prices and are valid for the entire term of the contract. If the manufacturer cancels an article without a successor model, the article is omitted. The contractor may offer successor articles. A successor article must at least meet the requirements for the precursor and must not be more expensive than the precursor in terms of price-performance ratio.

For the purposes of the calculation, discount rates on the general list price of the manufacturer are queried for the articles queried in the price sheet. In the case of successor models, the contractor will grant an identical discount rate. In the case of new models, the parties will agree on which discount class the new model should be grouped under. If no agreement is reached, the new model will not become part of the contract. Changes in prices may in principle result in a change in the order of precedence among the framework contract partners.
