The subject of the contract are services consisting in the ongoing maintenance of trees in the District of Włochy m.st. Warsaw in 2024.
The contracting authority provides for the application of Article 139 of the Public Procurement Law of 11 September 2019 (Journal of Laws of 2022, item 1710, as amended), hereinafter referred to as the "PPL Act".
1. The work shall consist, inter alia, of:
• comprehensive tree care,
• felling trees,
• removal of windbreaks,
• removing carps,
• removal of suckers,
• making elastic bonds,
• making rigid bonds,
• making minor technical cuts,
• planting trees,
• podlewaniu interwencyjnemu,
• tree dressing,
• other maintenance and cleaning works.
The contracting authority plans to perform not less than 50% of the value of the works provided for in the cost estimate. The Ordering Party reserves the right to change (increase or decrease) the number of units of measurement of treatments, given in the cost estimate in the event that during the performance of the Agreement there is a need to perform more of a specific scope of work (at the expense of reducing another scope of work). Changes made in this way may not exceed the contractor's remuneration specified for this purpose in § 4 section 1 of the Agreement.
2. Requirements related to the execution of the contract concerning employment by the Contractor or Subcontractor of persons on the basis of employment relationship (Article 95 Public Procurement Law).
2.1. The Contractor undertakes to employ under an employment contract all persons who, during the performance of the subject of the contract, perform activities indicated by the Contracting Authority in the field of contract performance, if the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code, i.e. persons/persons performing activities consisting in conducting gardening works in the field of care, felling and planting trees in green areas in the Włochy District m.st Warsaw.
2.2. The Contractor shall oblige the subcontractor to employ for the employment contract of all persons who, during the execution of the subject matter of the contract, carry out the activities indicated by the Contracting Authority, if the performance of such activities involves carrying out the work in the manner set out in Article 22 § 1 of the Act of 26 June 1974 — Labor Code.
3. Contracts referred to in Article 214(1)(7) of the PPL.
The Contracting Authority provides for the award of the contracts referred to in Article 214 (1) point 7 of the Pzp Act.
The subject of the contract will be works with a net value of up to PLN 69,512.50, consisting in repeating similar services included in the basic order, to the extent indicated, m.in. in the cost estimate.
These contracts will be awarded under conditions determined in accordance with the provisions of the Pzp Act.
