1. The subject of the contract is the supply of electricity for the State Administration Units indicated in Annex No. 1 to the Terms of Reference (SWZ). 2. The detailed lists of electricity consumption points (PPE) belonging to the State Administration Units are separate files in Excel format (named PPE lists.zip). 3. The planned estimated quantity of electricity for individual tariff groups is indicated in the Offer Form, which is Appendix No. 3 to the SWZ, and it represents the total amount of energy for all Units covered by this contract. 4. The planned estimated quantity of energy has been determined based on the planned needs of the State Administration Units, including the electricity consumption indicated in the PPE lists. 5. The detailed method of executing the subject of the contract is specified in Appendix No. 4 to the SWZ, which contains the Draft agreement provisions. 6. The contracting authority foresees an option right regarding the additional purchase of energy. The additional purchase of the subject of the contract (electricity supply) under the option right may not exceed 30% of the value of the basic contract (in total across all tariffs). Detailed conditions regarding the option right are specified in § 4 of Appendix No. 4 to the SWZ, which contains the Draft agreement provisions. 7. The contracting authority may annul the procurement procedure if the funds intended by the contracting authority to finance all or part of the order have not been granted. 8. The contracting authority informs that the order for the needs of: 1) The Ministry of State Assets will be co-financed from the European Regional Development Fund under Technical Assistance for European Funds 2021-2027; 2) The Ministry of National Education will be co-financed from the European Social Fund Plus under the program European Funds for Social Development. (Project No. FERS.06.01-IZ.00-0009/23 “Technical assistance FERS for the Ministry of National Education for the years 2024-2029”); 3) The Ministry of Funds and Regional Policy will be co-financed from European Union funds from the Cohesion Fund under the Technical Assistance Program for European Funds for the years 2021-2027; 4) The Ministry of Climate and Environment will be co-financed under the programs: European Fund for Eastern Poland, European Fund for Infrastructure, Climate, Environment; 5) The Ministry of Family, Labour and Regional Policy will be co-financed from Technical Assistance for FERS; 6) The Ministry of Health will be co-financed from the European Social Fund Plus under the European Funds for Social Development Program 2021-2027 and from the Cohesion Fund under the European Funds for Infrastructure, Climate, Environment Program 2021-2027; 7) The Provincial Inspectorate for Building Supervision in Krakow will be co-financed under the European Funds for Infrastructure, Climate, Environment Program 2021-2027 (FEnIKS). 9. The contracting authority does not foresee awarding contracts as referred to in Article 214 section 1 point 8 of the Public Procurement Law. 10. The contracting authority does not foresee conducting an electronic auction as referred to in Articles 227 - 238 of the Public Procurement Law. 11. The contracting authority does not allow the submission of variant offers within the meaning of Article 92 section 1 of the Public Procurement Law. 12. The contracting authority does not foresee concluding a framework agreement as referred to in Articles 311 - 315 of the Public Procurement Law. 13. The contracting authority does not foresee reimbursement of participation costs in the procedure, including reimbursement of costs incurred in obtaining a qualified electronic signature. 14. The contracting authority does not allow the submission of offers in the form of electronic catalogs or attaching electronic catalogs to the offer. 15. The contracting authorities are the State Administration Units listed in Appendix No. 1 to the SWZ, on behalf of which the Central Contracting Authority - the Government Administration Service Centre, ul. Powsińska 69/71, 02-903 Warsaw acts as the entity conducting the public procurement procedure. 16. All other requirements not included in this announcement are contained in the SWZ and attachments to the SWZ.

Supply of Electricity.

The supply of electricity will be based on separate sales agreements concluded by the contracting authority with the contractor for each of the Units. The condition for starting supplies to a given electricity consumption point is: 1) the Unit conducting a positive supplier change procedure, i.e., completing all formalities related to changing the supplier and necessary for performing the energy supply, 2) the Unit adjusting the measuring systems to the TPA principle (if such change is necessary), 3) the Units entering into separate distribution agreements (if such agreements have not been concluded by the Units), 4) the expiration or effective termination of the currently valid electricity sale agreements or comprehensive service agreements. 7. The contracting authority foresees an option right regarding the additional purchase of energy.
