Organization of trainings in the field of office and specialized IT applications for participants of the "Pomeranian e-Health" project

1. The subject of the Order is to develop a schedule and conduct training in the field of office and specialist IT applications, including:

1) Part 1 – Office software training

2) Part 2 – Specialized training – backup software

3) Part 3 – Specific training – databases

4) Part 4 – Specific training – Cybersecurity

5) Part 5 – Specific training – Anti-virus software

6) Part 6 – Specialized Training - Virtualization

7) Part 7 – Specific training – Operating Systems (Linux)

8) Part 8 – Specific Training - Operating Systems (Windows)

9) Part 9 – Specific training – Infrastructure

10) Part 10 – Training in domain systems

2. The Detailed Subject of the Order is specified in Annex 8 to this SWZ.

Part 1 – Office Software Training

1. The subject of the Order is to develop a schedule and conduct training in the field of office and specialist IT applications, including:

3. In all SWZ records and its annexes where the Ordering Party references or describes the subject of the order by:

1) the indication of the trademarks, patents or origin, source or specific process which characterizes the products or services provided by a particular Contractor, equivalent arrangements shall be permitted for all these cases.

2) reference to standards, technical assessments, technical specifications and technical reference systems, Pursuant to Article 101(4) of the PPL, the Contracting Authority shall allow solutions equivalent to those described. In a situation where the content of the SWZ the Contracting Authority has specified the permissible scope of equivalence, the Contractor, using equivalent solutions, within the limits allowed by the Contracting Authority in the SWZ, must specify the scope of the equivalent solution used. If the names of materials, products or equipment of specific manufacturers are given in the Description of the Subject of the Order, they should be treated only as a specification of the desired standard and quality. In all such situations, the Contractor may offer equivalent materials, products or equipment with at least the same parameters. Product equivalence is understood as offering a product whose technical parameters of the materials used are at least the same as those of the products described in the SWZ.

If an equivalent solution is offered, the Contractor shall demonstrate the equivalence of the solutions used. In this case, the contractor shall attach to the tender a list of equivalent solutions together with its description or standards.

4. The Contracting Authority shall not reserve the possibility of applying for the contract only by the Contractors referred to in Article 94 of the Pzp Act.

5. Subcontracting:

1) The Contractor may entrust the execution of part of the contract to the subcontractor (subcontractors);

2) In connection with the execution of the contract, the contracting person does not reserve the obligation to perform the key tasks of the order

3) The Contracting Authority requires that, in the event of entrusting part of the contract to subcontractors, the Contractor shall indicate in the offer the parts of the contract, the execution of which it intends to entrust to the subcontractors and provide (if they are already known) the names of those subcontractors together with the subject of the subcontracting contracts for which they are proposed;

4) Entrusting a part to subcontractors does not absolve the contractor from responsibility for the proper performance of the contract.

6. In addition, the Ordering Party informs that:

1) allows for the possibility of submitting partial bids - the Contractor may submit a bid for one, several or all parts of the contract;

2) does not allow for the possibility of submitting a variant bid referred to in Article 92 of the PPL, i.e. an offer providing for a different manner of performance of the contract than specified in this SWZ;

(3) does not provide for the conclusion of a framework agreement and the establishment of a dynamic purchasing system and does not provide for the selection of the most advantageous tender by means of an electronic auction;

(4) provides for the award of contracts pursuant to Article 214(1)(7) of the PPL;

5) does not provide for settlement in foreign currencies - the settlement of the order is carried out in PLN;

6) does not provide for reimbursement of the costs of participation in the proceedings;

7) does not provide for the granting of advances for the performance of the contract;

The Contracting Authority, acting pursuant to Article 95(1) and (2) of the Act, informs that it requires the Contractor and subcontractor(s) to employ persons performing activities on the basis of an employment contract

in the scope of contract performance, consisting in performing work in the manner specified in art. 22 § 1 of the Act of 26 June 1974 – Labor Code (i.e.: Journal of Laws of 2022, item 1510, as amended). Type of activities related to the performance of the contract to which the requirements of employment on the basis of the employment relationship apply: administrative and office activities.

In all such situations, the Contractor may offer equivalent materials, products or equipment with at least the same parameters. Product equivalence is understood as offering a product whose technical parameters of the materials used are at least the same as those of the products described in the SWZ.

If an equivalent solution is offered, the Contractor shall demonstrate the equivalence of the solutions used. In this case, the contractor shall attach to the tender a list of equivalent solutions together with its description or standards.

4. The Contracting Authority shall not reserve the possibility of applying for the contract only by the Contractors referred to in Article 94 of the Pzp Act.

5. Subcontracting:

1) The Contractor may entrust the execution of part of the contract to the subcontractor (subcontractors);

2) In connection with the execution of the contract, the contracting person does not reserve the obligation to perform the key tasks of the order

3) The Contracting Authority requires that, in the event of entrusting part of the contract to subcontractors, the Contractor shall indicate in the offer the parts of the contract, the execution of which it intends to entrust to the subcontractors and provide (if they are already known) the names of those subcontractors together with the subject of the subcontracting contracts for which they are proposed;

4) Entrusting a part to subcontractors does not absolve the contractor from responsibility for the proper performance of the contract.

6. In addition, the Ordering Party informs that:

1) allows for the possibility of submitting partial bids - the Contractor may submit a bid for one, several or all parts of the contract;

2) does not allow for the possibility of submitting a variant bid referred to in Article 92 of the PPL, i.e. an offer providing for a different manner of performance of the contract than specified in this SWZ;

(3) does not provide for the conclusion of a framework agreement and the establishment of a dynamic purchasing system and does not provide for the selection of the most advantageous tender by means of an electronic auction;

(4) provides for the award of contracts pursuant to Article 214(1)(7) of the PPL;

5) does not provide for settlement in foreign currencies - the settlement of the order is carried out in PLN;

6) does not provide for reimbursement of the costs of participation in the proceedings;

7) does not provide for the granting of advances for the performance of the contract;

The Contracting Authority, acting pursuant to Article 95(1) and (2) of the Act, informs that it requires the Contractor and subcontractor(s) to employ persons performing activities on the basis of an employment contract

in the scope of contract performance, consisting in performing work in the manner specified in art. 22 § 1 of the Act of 26 June 1974 – Labor Code (i.e.: Journal of Laws of 2022, item 1510, as amended). Type of activities related to the performance of the contract to which the requirements of employment on the basis of the employment relationship apply: administrative and office activities.
