The subject of the contract is to conduct winter maintenance of roads and sidewalks in the winter seasons 2023/2024 - 2024/2025 in the city and municipality of Niepołomice. A detailed list of roads is attached to the tender

1. The subject of the contract is to conduct winter maintenance of roads and pavements in the city and municipality of Niepołomice in the winter seasons 2023/2024 - 2024/2025. A detailed list of roads is attached to the tender.

2. Winter maintenance of roads and pavements includes the so-called active action, i.e. direct operation of equipment on the premises and will be carried out in the active duty system, i.e. when the Contractor finds bad weather conditions (snowfall, frost, drizzle, black ice) and in the intervention system, i.e. at the request of persons responsible on the part of the Contracting Authority for winter road maintenance.

3. In the case of taking action in the mode of active duty, the Contractor, when making a decision to start the action, is obliged to notify the Contracting Authority about this fact. The information should contain precise identification of the amount and type of equipment used.

4. Active action in the intervention system should be taken no later than 1 hour after notification by a designated employee of the Commune Office. In such a case, the Contractor is obliged to notify the Ordering Party about the type of equipment used, stating the make and registration number.

5. The Contractor is obliged to keep documentation of winter maintenance of roads and pavements containing a daily and weekly statement of the actual quantities of: kilometers of roads and pavements covered by winter maintenance, working hours for winter maintenance of roads and pavements with space for an entry of an employee of the Commune Office, who will confirm the actual services performed in accordance with the standard set by the Contracting Authority.

6. The execution of works related to winter maintenance of roads and sidewalks in the city and municipality of Niepołomice covers approx. 195 km of municipal and internal roads, approx. 39.20 km of district roads and approx. 24 km of sidewalks.

7. Winter maintenance of roads and pavements consists of:

a) removing winter slippery conditions on the roads by sprinkling with road salt and pavements with friction material (slag with a grain size of up to 10 mm, sand) with a tractor with a spreader and a sandblaster should comply with applicable standards and meet the requirements set out in environmental protection regulations. ATTENTION places of sprinkling, i.e. removing slippery with salt are: road crossings, sharp invisible curves, bus / bus stops, road sections in front of educational facilities and health centers.

b) clearing snow from roads and pavements with a deflated vehicle after each heavy snowfall causing impassability of roads. The Ordering Party requires that the entire range of roads covered by winter maintenance be cleared of snow within 5 hours after the snowfall has stopped.

8. The Contracting Authority requires that the winter maintenance of roads and pavements takes place simultaneously in all areas of the municipality of Niepołomice.

9. Friction material and road salt for sprinkling roads should be purchased by the Contractor, and its price should be included in the cost of the service.

10. The price shall be indicated in the following arrangement:

a) net/gross price for 1 hour of work, taking into account

- working on the sprinkling of roads and pavements (eliminating slippery roads) - 3900 hours (1950 hours in the season),

- working on snow removal of roads and pavements - 3900 hours (1950 hours in the season),.

11.During the performance of the subject of the contract, the Contractor is obliged to maintain telephone communication with a designated person from the Commune Office and provide information on the current condition of roads and pavements

Employment requirement on the basis of employment relationship

1. Since the performance of this contract must be carried out by performing activities under the conditions specified in Article 22 § 1 of the Act of 26 June 1974 Labour Code - for the contractor or subcontractor, at the place and time indicated by the contractor or subcontractor - the contracting authority, in accordance with Article 95 paragraph 1 of the PPL, requires the contractor or subcontractor to employ persons performing activities falling within the so-called direct costs on the basis of an employment relationship.
