1. The subject of the contract is the supply of surgical instruments to the Copernicus Hospital.

3. A detailed description of the subject of the contract specifying the requirements of the Ordering Party, quantity, is included
in Appendix No. 1 to SWZ – Assortment and price form and in Appendix No. 5 to SWZ – Draft contract.
By completing the items indicated in Annex 1 to the SWZ, the Contractor confirms compliance with the requirements set out
by the Ordering Party.
4. The offered objects of the contract must be complete, of a high standard both in terms of
quality and functionality, as well as free from material, construction and legal defects.

7. In all provisions of the SWZ and its annexes, in which the Ordering Party refers to standards, approvals,
technical specifications or reference systems or trademarks, parameters or sources of origin (names of manufacturers or equipment) are indicated, in accordance with Article 99(5) and Article 101(4) of the PPL, the Contracting Authority shall allow equivalent solutions.
8. The subject of the contract must comply with the Act of 7 April 2022 on medical devices (i.e. Journal of Laws 2022.974 of 2022.05.09.), if the Ordering Party requires offering an assortment constituting a medical device.
9. The Contracting Authority does not reserve the right to apply for a contract only by the Contractors referred to in Article 94 of the PPL Act.
10. The contracting authority does not impose the requirements referred to in Article 96 of the PPL.
