Description:
Delivery, implementation, and integration of IT systems for DCOPiH, including medical documentation digitization and integration with the Intelligent Services Platform, along with testing, training, and technical support.

The subject of the order is the delivery, implementation and integration of IT systems for DCOPiH along with digitization of medical documentation, integration with the Intelligent Services Platform, conducting tests, training and providing warranty and technical support for 36 months. The order is co-financed from the funds of the National Reconstruction and Resilience Plan Component D "Effectiveness, availability and quality of the health care system" Investment D1.1.2 "Accelerating the processes of digital transformation of health care through further development of digital services in health care" as part of the project titled "Improvement of the quality and accessibility of health services through digitization, integration of systems and development of cybersecurity at the Lower Silesian Center of Oncology, Pulmonology and Hematology" no. KPOD.07.03-IP.10-0149/25. A detailed description of the subject of the order referred to in point 3.1 is included in annex no. 10 to the SWZ – Description of the Subject of the Order, annex no. 10a to OPZ – List of Functions, annex no. 2 - Price and assortment sheet, annex no. 8 to SWZ - Draft contract, annex no. 14 – Schedule of Order Implementation.
2.6. The Contracting Authority does not allow the submission of partial offers – justification for not dividing the order into parts: The order was not divided into parts due to its subject character – all modules and integrations constitute elements of one HIS CompuGroup Medical system, which must operate as a coherent solution. Division into parts would be technically impossible and could threaten the interoperability and security of medical data. Implementation requires a single contractor who has the copyrights to the source code and full technical knowledge, in accordance with Article 91(2) of the Public Procurement Law (inability to divide for technical and organizational reasons).
2.7. The Contracting Authority does not allow for variant offers.
2.8. The Contracting Authority does not allow for equivalent offers.
2.9. The Contracting Authority does not foresee the conclusion of a framework agreement.
2.10. The Contracting Authority does not foresee orders referred to in Article 214(1)(8) of the act.
2.11. The Contracting Authority does not foresee holding an electronic auction.
2.12. According to Article 257 point 1 of the Pzp, the Contracting Authority foresees the possibility of canceling the subject proceeding if the funds that the Contracting Authority intended to allocate for financing all or part of the order have not been granted to him.
2.13. The Contracting Authority informs that before the opening of offers, in accordance with Article 222(4) of the Pzp, it will specify the amount that it intends to allocate for the execution of the order, for the purpose of verification of the updated basis for cancellation of the proceeding referred to in Article 255 point 3 of the Pzp.
2.14. Requirements regarding employment on the basis of an employment relationship, in the circumstances referred to in Article 95 of the Pzp. - The Contracting Authority does not foresee requirements in this respect.
2.15. Requirements regarding the employment of persons referred to in Article 96(2)(2) of the Pzp. - The Contracting Authority does not foresee requirements in this respect.
2.16. Information on the reservation of the possibility of applying for the award of the contract only by Contractors referred to in Article 94 of the Pzp. - The Contracting Authority does not foresee reservations in this respect.
2.17. Requirements concerning the options - The Contracting Authority foresees the possibility of using the right of option in accordance with Article 441 of the Pzp.
2.18. The Contracting Authority does not foresee settlement in foreign currencies.
2.19. The Contracting Authority does not foresee the establishment of a dynamic purchasing system.
2.20. The Contracting Authority does not foresee the refund of costs of participation in the proceedings - unless the prerequisites referred to in Article 261 of the PZP are met.
2.21. The Contracting Authority does not reserve the requirement nor allow the possibility of submitting offers in the form of electronic catalogs or attaching electronic catalogs to the offer, in the situation specified in Article 93 of the Pzp.
2.22. The Contractor is obliged to obtain all information that may be necessary to prepare the offer and sign the contract.
2.23. The proceedings are conducted in Polish.
2.24. The Contracting Authority allows the participation of Subcontractors in the execution of the order.
2.25. The Contracting Authority requires the Contractor in the offer to indicate the parts of the order that it intends to assign to subcontractors and to provide the names of subcontractors – in accordance with Article 462(2) of the Pzp, if they are already known.
2.26. If a change or resignation from a subcontractor concerns an entity on whose resources the contractor relied, under the principles specified in Article 118(1), in order to demonstrate fulfillment of the conditions for participation in the proceedings, the contractor is obliged to prove to the contracting authority that the proposed other subcontractor or contractor independently meets them to a degree not less than the subcontractor on whose resources the contractor relied during the contract awarding procedure. The provision of Article 122 of the act applies accordingly.
NOTE: pursuant to Article 5k of Council Regulation (EU) No 833/2014 of July 31, 2014, concerning restrictive measures in connection with actions by Russia destabilizing the situation in Ukraine (i.e. Journal of Laws of 2024, item 507, as amended as: "the act") - it is prohibited to assign part of the contract to subcontractors (including service and supply subcontractors), regarding whom there are grounds referred to in Article 5k(1)(a)-(c), in the case where they receive more than 10% of the contract value.
2.27. The Contracting Authority does not reserve the obligation of the contractor to personally execute key parts of the order.
2.28. Assigning part of the order to subcontractors does not relieve the contractor of responsibility for the proper execution of the order.
2.29. The Contracting Authority does not impose a requirement for a contractor who intends to assign part of the execution of the order to subcontractors (but does not rely on the resources of those subcontractors) to demonstrate the absence of grounds for exclusion from participation in the proceedings and to submit a single document concerning subcontractors (Article 462(5) of the Pzp).

3.1. The subject of the order is the delivery, implementation and integration of IT systems for DCOPiH along with digitization of medical documentation, integration with the Intelligent Services Platform, conducting tests, training and providing warranty and technical support for 36 months.
3.2. A detailed description of the subject of the order referred to in point 3.1 is included in annex no. 10 to the SWZ – Description of the Subject of the Order, annex no. 10a to OPZ – List of Functions, annex no. 2 - Price and assortment sheet, annex no. 8 to SWZ - Draft contract, annex no. 14 – Schedule of Order Implementation. 6.3. If the Contractor has its registered office or residence outside the territory of the Republic of Poland, instead of the documents referred to in section 6.2. of this chapter, it submits:
a. information from the National Criminal Register referred to in Article 108(1)(1) and (2) and (4) – submits information from the relevant register, such as a court register, or in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country where the contractor has its registered office or residence or where the person to whom the information or document relates resides;
b. instead of the certificate from the relevant head of the tax office confirming that the contractor does not owe taxes and fees, in the scope of Article 109(1)(1) of the act, instead of the certificate or other document from the relevant organizational unit of the Social Insurance Institution or the relevant local unit of the Agricultural Social Insurance Fund in the scope of Article 109(1)(1) of the act, instead of an excerpt or information from the National Court Register or the relevant register or the Central Register and Information on Economic Activity, in the scope of Article 109(1)(4) - submits a document or documents issued in the country where the contractor has its registered office or residence, confirming respectively that:
1) it has not violated obligations concerning the payment of taxes, fees or social or health insurance contributions,
2) it has not been opened for liquidation, has not been declared bankrupt, its assets are not managed by a liquidator or a court, has not entered into a settlement with creditors, its business activity is not suspended or it is not in another such situation resulting from a similar procedure provided for in the regulations of the place of commencement of this procedure.
6.4. If in the country where the contractor has its registered office or residence or where the person to whom the document applies resides, documents referred to in point 6.2 (1) are not issued, or if these documents do not apply to all cases referred to in Article 108(1)(1), (2) and (4), Article 109(1)(1), (2)(a) and (b) and point (3) of the act, they are replaced entirely or in part by a document containing respectively a statement of the contractor, indicating the person or persons authorized to represent it, or a statement of the person to whom the document was to refer, made under oath, or, if in the country where the contractor has its registered office or residence or where the person to whom the document was to refer resides, there are no provisions for a sworn statement, submitted before a judicial or administrative authority, a notary, or a professional or economic self-government authority, competent due to the registered office or residence of the contractor or the place of residence of the person to whom the document was to refer.
6.5. In the event of the contractor indicating the availability of the documents or declarations required in this chapter in electronic form at a specified website of publicly available and free databases, the Contracting Authority will independently download from these databases the statements or documents indicated by the contractor.
6.6. The documents referred to in section 6.2 (1) must be issued not earlier than 6 months before their submission and the document referred to in section 6 (2) and (3) must be issued not earlier than 3 months before their submission.
6.8 Documents other than declarations are submitted in original in the form of an electronic document or in an electronic copy of the document certified as compliant with the original.
6.9. Documents made in a foreign language are submitted along with a translation into Polish.
6.10. The contractor who refers to the resources of other entities, in order to demonstrate the absence of grounds for exclusion towards them and the fulfillment of the conditions for participation in the proceedings to the extent to which it refers to their resources, submits identical documents concerning those entities. – subject to point 6.11.
6.11. JEDZ. The contractor must attach the standard form of the European Single Procurement Document - JEDZ valid on the date of bid submission. The information contained in the statement will constitute preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the proceedings.
