The subject of the contract is the delivery and transport of liquid fuel, i.e. diesel oil, to a tank at the landfill in Końskie in the estimated amount of 250,000 litres.
1. The subject of the contract is the supply and transport of liquid fuel, i.e. diesel oil, to a tank at the landfill in Końskie in Końskie. quantities of 250,000 l. 2. The Contractor is obliged to ensure constant, successive deliveries (2-4 times a month) according to the reported needs for the duration of the contract. The size of the tank is 2 x 5,000 liters.
3. The place of fuel delivery is: PGK Petrol Station in Końskie, 145 Spacerowa Street. 4. The contractor will be required to have a paid policy or other insurance document confirming that it is insured against civil liability in the scope of its activities related to the subject of the contract for the duration of its implementation in the amount of not less than PLN 500 thousand (five hundred thousand zlotys). 5. The Contractor is obliged to deliver fuel of quality and parameters (composition) in accordance with the provisions of law - the Act of 25.08.2006 on the fuel quality monitoring and control system (i.e. Journal of Laws of 2023, item 846), the Regulation of the Minister of Economy of 9.10.2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680) and the parameters of the PN-EN 590+A1:2017 standard, And in the event of a change in regulations or standards, the fuel supplied will comply with the changed regulations and standards.
6. The Contractor shall attach to each delivery of fuel a document concerning the quality of a given batch of fuel, in particular specifying the physicochemical parameters (quality certificate) in the original or a certified copy.
7. The Contractor is obliged to include in the issued VAT invoice the unit of measurement: litres or should include the conversion rate of the amount of m3 of fuel delivered into litres. 8. The Contracting Authority requires the Contractor to deliver by a tanker equipped with a pump or a distributor that meets all the requirements of the applicable law, in particular the Act of 11.05.2001. The Law on Measures and Implementing Acts to the Act in the field of road tankers (vehicles for the transport of liquid fuels). The vehicle used for fuel deliveries should be equipped with
into a legal-for-trade measuring device measuring the amount of fuel discharged to a container filling station. Both the tank and the measuring device should have important features of legalization and a set of undamaged seals applied by an authorized authority.
9. The Contractor shall ensure the organization and execution of safe deliveries of fuel, the grade of which will be appropriate to the season and the prevailing temperature conditions in terms of cloud point and cold filter blockage point. 10. The Ordering Party shall submit a request for a current supply specifying the quantity by e-mail or phone to the number provided by the Contractor. The Contractor is obliged to confirm the order in the form of an e-mail each time.
11. The Contractor is obliged to deliver fuel to the Contracting Authority within 48 hours from the date and time of placing the order. The driver carrying out the delivery is obliged to have and present documents confirming the legalization of the tanker (tank and measuring device) - it is allowed to present a certified copy of the documents. 12. Upon receipt, an authorized employee of the Ordering Party may check the legalization documents of the tanker (tank and measuring device) and take a sample of fuel into a container, which will then be closed and sealed - the seal will bear the signatures of: an authorized employee of the Ordering Party and a representative of the Contractor – the driver. The sample taken is the basis for pursuing possible claims for improper quality of fuel. Sample containers and seals are provided by the Contractor.
13. The receipt of fuel will be confirmed by a proof of delivery on the basis of the indications of the tanker's measuring device, subject to point 14. 14. In the event of violation of the provisions of points 8 and 11, the amount of fuel supplied shall be determined on the basis of the indications of the Ordering Party's measuring bar – non-legalised devices.
