I.The subject of the order is:
Development of comprehensive documentation for the investment task entitled: "Extension of the provincial road No. 857 Zaklików - Modliborzyce".
II. The Contractor whose bid is considered the most advantageous shall be obliged to lodge a performance bond in the amount of 5% of the gross offer price, calculated in accordance with § 5(1)-(4) of the model contract.
III. At the written request of the Contractor, the Contracting Authority shall grant the Contractor a one-off advance for the performance of the subject of the Agreement, in the amount of 5% of the Contractor's gross remuneration referred to in § 5 clauses 1-2 (maximum value) (hereinafter referred to as the advance payment).
IV. The contracting authority provides for the cancellation of the procedure within the meaning of Article 257 of the Public Procurement Law.
1.The basic purpose of the order is:
a) Development of multi-discipline comprehensive design documentation at the stage of Construction and Executive Projects together with geodetic and legal documentation, decisions and all arrangements and opinions, for the project entitled "Extension of the provincial road No. 857 Zaklików - Modliborzyce" enabling the submission of an application and obtaining a decision on the permit for the implementation of a road investment (ZRID decision) pursuant to the Act of 10 April 2003 on specific rules of preparation and implementation of investments in the field of public roads (consolidated text: Journal of Laws of 2022, item 176, as amended) along with obtaining the required opinions on the application and preparing the application together with materials for the application for obtaining this decision.
(b) Development of materials and obtaining the attachments necessary to obtain a decision on the environmental conditions with its obtaining by the Contractor.
(c) The development of materials and obtaining the annexes necessary for obtaining a waterproofing authorisation/water-legal consent with its obtaining by the Contractor.
(d) the development of the materials necessary for the invitation to tender for the performance of the construction works required by the Law of Public Procurement and subsequent implementation of the task.
2. The detailed scope of the object of the order is included in the “Description of the Order Subject” (hereinafter referred to as “OPZ” as annexed to the SWZ.
The contracting authority in OPZ specified that the subject of the contract, i.e. the project, is to include, m.in. "Removal of architectural barriers within the extended road section to ensure accessibility for all users, in particular for the disabled" (point 2.2 of the OPZ), and thus as a public facility after the completion of the extension, it will not have accessibility restrictions by all road users, including the disabled, which is required by the provisions on m.in requirements for technical conditions to be met by public roads (consolidated text: Journal of Laws of 2022, item 1518, as amended) and buildings (consolidated text: Journal of Laws of 2022, item 1225, as amended).
3. In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ 2016/679, p. UE L 119 of 04.05.2016, p. 1), hereinafter referred to as "GDPR", I inform that:
