The project involves the modernization of the network and procurement of a SOC system to enhance medical documentation security at WS-SP ZOZ in Zgorzelec, including the implementation of an SD-WAN network and internet connection upgrades for multiple locations.

Modernization of the network and purchase of the SOC system to enhance the security of medical documentation at WS-SP ZOZ in Zgorzelec. NR CONSISTENT WITH SWZ: 2.2. The contracting authority allows the submission of equivalent bids. In the event that the contracting authority defines the subject of the contract by referencing trademarks, patents, or origin, source, or a specific process that characterizes products or services provided by a particular contractor/producer, which could lead to privileging or eliminating certain contractors or products - the contracting authority allows the submission of equivalent bids. The aforementioned description of the subject of the contract is solely auxiliary in preparing the bid and is intended to indicate the expectations of the contracting authority. An equivalent bid is understood to mean an offer with parameters no worse than those indicated by the contracting authority. The parameters specified by the contracting authority are minimal, boundary parameters. "Parameters" include functionality, intended use, color, structure, materials, size (only in the case of the permissible difference indicated by the contracting authority: +/-), safety, durability, form, dosage, etc. In connection with the above, the contracting authority allows the possibility of offering the subject of the contract with different trademarks, patents, or origins mentioned above - however, it does not allow offering an object with different properties or functionalities than specified in the SWZ. The contractor who accepts equivalent solutions for valuation is obliged to prove the equivalence of the devices, equipment, and materials accepted. In order to confirm that the offered equivalent solution meets the requirements specified in the SWZ, the contractor must submit with the bid a detailed description of the offered equivalent subject of the contract in which for each product they determine the manufacturer’s name, type/model, and other characteristics of the product that allow for unambiguous identification of the offered product and confirmation of compliance with the description of the subject of the contract. Failure to submit such a list will be equivalent to accepting the solutions indicated in the documentation. The applied equivalent solutions: No./Description of the subject of the contract - requirements of the contracting authority/Trade name, catalog number, size of packaging or other identification of the subject/Description of the offered equivalent subject.

2.3. The contracting authority does not allow the submission of variant bids (Article 92 of the Act). 2.4. The contracting authority does not anticipate the conclusion of a framework agreement. 2.5. The contracting authority does not foresee awarding the contracts referred to in Article 214(1)(7) and (8) of the Act. 2.6. The contracting authority does not foresee an electronic auction. 2.7. The contracting authority does not require conducting a site visit or checking documents necessary for the execution of the contract by the contractor, as referred to in Article 131(2) of the PZP Act. 2.8. The contracting authority does not allow the possibility of settling in foreign currencies. 2.9. The contracting authority requires the contractor to indicate in the bid parts of the contract that they intend to subcontract, as well as to provide the names of any subcontractors, if known. 2.10. The contracting authority requires that before starting the execution of the contract, the contractor, if known, provide the names and contact details of subcontractors and the persons to contact with them, involved in the execution of the contract. The contractor informs the contracting authority about any changes to the data mentioned above during the execution of the contract and also provides information on new subcontractors they intend to entrust with the execution of supplies later on. 2.11. If the change or resignation from a subcontractor concerns the entity whose resources the contractor relied on, under the principles indicated in Article 118(1), to demonstrate meeting the participation conditions in the procedure, the contractor is obliged to show the contracting authority that the proposed other subcontractor or contractor independently meets them to no less extent than the subcontractor whose resources the contractor relied upon during the contracting procedure. 2.12. The contracting authority does not foresee the possibility of providing advances for the execution of the contract. 2.13. The contracting authority does not foresee the reimbursement of costs incurred in relation to participation in the procedure, except in the situations referred to in Article 261 of the Act. 2.14. The contracting authority reserves, according to Article 139 of the Act, that it will first carry out an examination and evaluation of the offers, and then will qualify the contractor's entity whose offer was rated highest, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure. 2.15. The contracting authority does not allow the submission of offers in the form of electronic catalogs or attaching electronic catalogs to the offer, in the situation specified in Article 93 of the PZP Act. 2.16. The contracting authority, in part IV of the Standard Form of the Single European Procurement Document, requires the alpha part to be filled out.

3. Description of the subject of the contract. 3.1. The subject of the contract is: Modernization of the network and purchase of the SOC system to enhance the security of medical documentation at WS-SP ZOZ in Zgorzelec. Task 1: Purchase of a SOC/SIEM system for 36 months Task 2: Implementation of an SD-WAN network and modernization of internet connections for 25 locations 3.2. CPV code: Package No. 1 and 2 72700000-7 - Computer network services 3.3. The description of the subject of the contract is included in attachments No. 2, 3, 4, and 8.1, 8.2 to the SWZ. 3.4. The contracting authority requires that for the execution of the actions indicated below, related to the realization of the subject of the contract, the contractor employs staff based on an employment contract within the meaning of the provisions of the Act of June 26, 1974, Labor Code (i.e. Journal of Laws of 2023, item 1465) i.e.: a) In the scope of Package No. 1 - installation, implementation, and monitoring of the network b) In the scope of Package No. 2 - implementation and modernization of internet connections C.D.
