The subject of this contract is the supply of electricity in accordance with the provisions of the Act of 10 April 1997. Energy Law (Journal of Laws of 2022, item 1385, as amended) for municipal public utility facilities and street lighting in the City and Commune of Niepołomice.
The total estimated energy consumption [kWh] in the period from 01.01.2024 to 31.12.2025 is 20 981 955 kWh. The material scope of the subject of the contract covered by this procedure is determined by a detailed description of the subject of the contract (Annex to the SWZ) and the draft contract (Annex to the SWZ).
The value of the energy actually purchased may differ from the declared and will depend on the actual demand of the Ordering Party, and the Ordering Party will not suffer any consequences in this respect. The electricity demand and the value of the purchase of energy are only estimated values.

The subject of this contract is also the supply of electricity taking into account the requirements of:
Air Quality Plan for the Malopolska Region - Resolution No. xxv/373/20 of the Małopolska Regional Assembly of September 28, 2020. Action 1. Reducing low emissions and improving energy efficiency 2, in which the Commune, District and Voivodship are obliged to provide at least 50% from 1 January 2023, and from 1 January 2025 100% of the electricity consumed during the year by public buildings owned by them - will come from renewable sources. The goal can be achieved through the supply of energy certified, m.in by a guarantee of origin of electricity from renewable RES sources. The subject of this contract is also the supply of electricity including for the following facilities:
- 590322429200000071, PPE in the Royal Castle in Niepołomice, 2 Zamkowa Street (connection I), PV power 99,9 kW;
- 590322429200000088, PPE in the Royal Castle in Niepołomice, 2 Zamkowa Street (connection II), PV power 40.4 kW.
presentation and implementation in practice of an agreement for the sale of electricity generated in a renewable energy source with the launch of a balancing mechanism for energy collected and returned to the DSO Network.
NOTE: The contracting authority obliges the contractor to invoice public utility facilities separately (one object - one invoice). Street lighting points should be invoiced collectively - applies to points listed in the Description of the subject of the contract for the Municipality.
Entity, i.e. Infrastruktura Niepołomice sp. z. o.o. reserves the right of option.
Conditions for exercising the option:
Infrastruktura Niepołomice sp. z o.o. has the right to increase the amount of remuneration specified in the offer by no more than 30% if before the end of the contract period the electricity consumption by this entity reaches the value specified in the contract (option right), while maintaining the offer prices.
Infrastruktura Niepołomice sp. z o.o. informs the Contractor about exercising the option right in writing, stating the value by which the amount of remuneration will be increased
