Description of the subject of the contract • Collection and management of municipal waste directly from real estate throughout the city of Orzesze, where residents live in the period from March 1, 2023 to March 31, 2024 (in accordance with the annex); • Collection and management of non-segregated (mixed) municipal waste; • Collection and management of separately collected municipal waste (paper, glass, metals, plastics, multi-material packaging waste, bio-waste, ash); • Retrofitting of real estate with containers for ash and slag from home hearths and with containers for bio-waste; • Retrofitting multi-family and multi-family properties with sets of containers for waste segregation (paper, glass, metals, plastics, multi-material packaging waste); • Retrofitting single-family residential properties with bags for selective waste collection (paper, glass, metals, plastics and multi-material packaging waste); • Collection and management of bulky waste, used tires and waste electrical and electronic equipment (once a year); • Collection and management of waste as part of the "Autumn leaf collection" campaign in the autumn period, including delivery of waste bags (once a year, maximum number of bags with a capacity of 120 l: 10,000 pcs.) • Equipping the Selective Municipal Waste Collection Point with containers and containers for waste collection; • Collection and management of waste from the Selective Municipal Waste Collection Point • Development and delivery of waste disposal schedules for all properties living in the city of Orzesze • Providing service to the Selective Municipal Waste Collection Point (PSZOK) in the form of employment of employees. Means of proof in question: The contracting authority does not require the submission of the means of proof in question in the proceedings in question. 1.5. The Contracting Authority does not require the Contractor to carry out an on-site inspection or to check by it the documents necessary for the performance of the contract, referred to in Article 131(2) of the Act. 1.6 . The contractor, subcontractor, further subcontractor performing activities in the scope of the performance of the contract is obliged to employ persons on the basis of an employment contract, i.e. persons performing activities under this contract, where the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974. Labour Code (consolidated text: Journal of Laws of 2020, item 1320). The Contractor is obliged to ensure that subcontractors and further subcontractors also meet all the requirements for persons employed under a contract of employment. The requirement of employment under an employment contract applies to persons who perform activities directly related to the performance of the service, i.e. collection of municipal waste (drivers and persons involved in loading waste), and persons performing supervision over the implementation of the contract and directing and disposing of car rolling stock. Therefore, the requirement does not apply, among others, to persons managing the construction site, performing transport services, performing geodetic services, suppliers of building materials, equipment, devices, natural persons conducting business activity, incumbent members of the management or supervisory bodies of the Contractor, partners of a general or partner company to the extent that they will personally perform works for the Ordering Party or the Contractor. The method of verifying the employment of persons, checking the contractor's compliance with the requirements related to employment, sanctions for non-compliance with these requirements are described in the Proposed provisions of the contract, constituting an annex to the SWZ.
