1. The subject of the Contract is the modernization of the 110/15 kV RPZ-9 Białystok power station in the area of PGE Dystrybucja S.A. Branch Białystok.
2. The Detailed Description of the Subject of the Contract is included in Annex No. 1 to the Terms of Reference (SWZ) and 1.1 to the SWZ.
3. The Contracting Authority requires the employment of persons performing activities specified in Annex No. 2 to the SWZ during the execution of the contract based on an employment contract by the Contractor or Subcontractor. The method of verifying the employment of these persons and the rights of the Contracting Authority regarding the control of the Contractor's compliance with the requirements related to the employment of these persons and the sanctions for failure to meet these requirements are included in the proposed provisions of the Agreement, which constitute Annex No. 2 to the SWZ.
4. The Contracting Authority reserves the right to cancel the public procurement procedure if the public funds intended for financing the entirety/part of the order are not granted to it.
5. Whenever the Contracting Authority describes the subject of the contract by referring to standards, technical evaluations, technical specifications and systems of technical references, as referred to in Article 101(1)(2) and (3) of the Public Procurement Law, it should be understood that in accordance with Article 101(4) of the Public Procurement Law, equivalent solutions are also permitted.
6. The subject of the contract – modernization of the 110/15 kV RPZ-9 Białystok power station in the area of PGE Dystrybucja S.A. Branch Białystok is part of the project entitled “Development of an Intelligent Power Grid in the Area of the Białystok Branch of PGE Dystrybucja S.A. – II” co-financed by the European Fund for Eastern Poland 2021-2027 (Priority FEPW.02 Energy and Climate, action FEPW.02.01 Energy Distribution) under the funding agreement No. FEPW.02.01-IP.03-0003/24-00.
