1. The subject of the contract is the modernization and expansion of the Client's teleinformatics infrastructure, including the supply of hardware, software, and licenses, divided into 7 parts.
2. The contractor is obliged to supply, install, configure, and start up the provided solutions, as well as to ensure warranty and compatibility with the existing infrastructure of the Client. The aim of the contract is to increase the efficiency, security, reliability, and to ensure the scalability and continuity of information systems operation.
3. The subject of the order is carried out within the framework of the project titled "Accelerating the Processes of Digital Transformation in Healthcare Through Further Development of Digital Services in Healthcare at the Praski Hospital under the Name of the Transfiguration of the Lord Ltd.", under Investment D1.1.2 "Accelerating the Processes of Digital Transformation in Healthcare Through Further Development of Digital Services in Healthcare", which is a component of the D "Effectiveness, accessibility, and quality of the healthcare system" under the Recovery and Resilience Facility (KPO).
4. DNSH Principle - "Do No Significant Harm": 1) In connection with the received funding, it is necessary to comply with the DNSH principle (Do No Significant Harm – "Do not cause significant harm"), resulting from EU Regulation 2020/852 (EU Taxonomy). This means that the project implementation will not cause significant harm to any of the six environmental objectives: a) climate change mitigation, b) climate change adaptation, c) sustainable use and protection of water and marine resources, d) transition to a circular economy, e) pollution prevention, f) protection and restoration of biodiversity and ecosystems. 2) The actions provided for in the project are of a digital and infrastructural nature, do not include construction works or interference with the natural environment. 3) Compliance with the RoHS directive: a) In the implementation of the contract, all supplied devices, hardware, and electronic components must comply with the Directive of the European Parliament and of the Council 2011/65/EU on the restriction of the use of certain hazardous substances in electrical and electronic equipment (RoHS 2) and its subsequent amendments. b) The contractor is obliged to ensure that the supplied equipment: does not contain hazardous substances exceeding the permissible values specified in the RoHS directive, is marked in accordance with RoHS requirements, and has appropriate manufacturer declarations or certificates confirming compliance. c) The Client, in this procurement procedure, requires the contractor to provide a statement confirming compliance with the DNSH and RoHS principles, as part of the evidence submitted with the bid. i.e.: Contractor's statement that the offered equipment is made from environmentally safe materials and does not contain hazardous substances, particularly those subject to restrictions arising from the RoHS directive. 4) The aim of the above requirements is to ensure that the contract execution does not have a negative impact on the environment and is consistent with the DNSH principle (Do No Significant Harm).
5. Equivalence. If in the document forming part of the description of the contract subject, there are indications of trademarks, patents, or origin, source, or particular process characterizing products or services provided by a specific supplier (if it could lead to the privileging or elimination of some contractors or their products), it should be understood, in accordance with the provision of article 99 paragraph 5 of the Public Procurement Law, that the contracting authority cannot describe the subject of the order in a sufficiently precise and understandable way, and in such circumstances, the contracting authority allows the possibility of submitting equivalent solutions in the offer, indicating that the minimum requirements that equivalent solutions must meet are not worse than the parameters indicated in these documents, and their criteria for assessing equivalence are indicated in the description of the subject of the order. Detailed conditions are contained in the Specification of Terms of Reference.
6. Information on non-eligible expenditures (if applicable): The contracting authority does not allow the purchase of used fixed assets that have been co-financed with EU or national funds in the last 7 years.
7. The contracting authority requires the submission of the relevant evidence with the offer. Details are specified in the procurement terms.
8. The contracting authority requires securing the proper performance of the contract regarding parts No. 1-7 details in the procurement terms and contract draft.
9. The contracting authority reserves the right to cancel the procurement procedure in accordance with article 257 of the Public Procurement Law due to lack of funds, if the public funds that the contracting authority intended to allocate for financing all or part of the contract have not been granted to it.
