Description:
The contract involves delivering a new unmanned aerial vehicle for the 'Public Safety Technology Center' project at Wrocław University of Science and Technology, with all associated costs covered by the Contractor.

1. The subject of the contract is the delivery of an unmanned aerial vehicle as part of the project titled 'Public Safety Technology Center', contract number FEDS.01.01-IZ.00-0003/24, carried out by Wrocław University of Science and Technology. All costs associated with the execution of the subject of the contract, including delivery, insurance, and risk, are borne by the Contractor. The Ordering Party declares that the subject of this agreement is co-financed from European Funds for Lower Silesia 2021 – 2027, Priority 1 European Funds for Entrepreneurial Lower Silesia. Activity 1.1. Development of scientific units, Type 1.1.A Investments in the development of public research infrastructure. 2. Place of delivery: Wrocław University of Science and Technology, ul. Na Grobli 15, 50-421 Wrocław, building L-1, room 090. 3. A detailed description of the subject of the contract is found in Annex No. 3 to the SWZ - OPZ. 4. A detailed scope of execution of the subject of the contract, being the projected provisions of the public procurement contract, is found in the template agreement, which is Annex No. 2 to the SWZ. 5. The delivered subject of the order must be brand new, not exposed at exhibitions, complete, and technically efficient. The term 'brand new' is to be understood as the subject of the order originally packaged, unused before the date of delivery, excluding usage necessary to carry out tests of its proper operation after production. The subject of the order must be free from any physical and legal defects and claims by third parties. 6. The delivered subject of the order must come from the official distribution channel of the manufacturer, not excluding distribution to the European Union market and ensuring the fulfillment of warranty rights. 7. The offered subject of the order must not be designated by the manufacturer for withdrawal from production or sale (End of Life, End of Support, End of Sale) by the deadline for submission of offers. 8. Delivery deadline: up to 2 months from the date of signing the contract. 9. According to Article 257 of the Public Procurement Law, the Ordering Party reserves the right to annul this procedure if the funds that the Ordering Party intended to allocate for financing the entirety or part of the order have not been granted. 10. The Ordering Party anticipates the use of the so-called inverted procedure, mentioned in Article 139, paragraph 1 of the Public Procurement Law, i.e., the Ordering Party will first examine and evaluate offers, and then qualify the Contractor whose offer was rated highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure. 11. The Contractor is bound by the offer from the day the deadline for submission of offers expires for no longer than 90 days. 12. The offer must consist of: 12.1. the Contractor's offer form – an interactive form available on the e-Procurement Platform, indicating, in particular, the offer price for the entirety of the subject of the order) 12.2. a declaration referred to in Chapter VII point 1 of the SWZ - JEDZ - an interactive form available on the e-Procurement Platform 12.3. a declaration referred to in Chapter VII point 1a of the SWZ - (respectively) Declaration Annexes No. 5.1 and 5.2 to the SWZ; 12.4. (if applicable) a commitment from the entity providing resources, referred to in Chapter VII point 6 of the SWZ; 12.5. (if applicable) evidence of reserving information constituting business secrets in accordance with Chapter X point 6; 12.6. document(s) demonstrating the right to sign the Offer, i.e., to confirm that the person acting on behalf of the Contractor is authorized to represent it, the Ordering Party requires a copy or information from the National Court Register, the Central Register and Information on Business Activity, or another appropriate register 12.7. (if applicable) Statement of contractors jointly applying for the order - according to Article 117, paragraph 4 of the Public Procurement Law. 12.8. the relevant pieces of evidence in accordance with point 13 of Chapter II of the SWZ regarding equivalent offers (if applicable). 12.9. Annex No. 3 to the SWZ OPZ - description of the offered subject of the order (technical specification) along with the Remuneration Specification - confirming that the Contractor meets the Ordering Party's requirements (along with any Information for Contractors) The Contractor submits together with the Offer duly completed and signed: Annex No. 3 to the SWZ The Ordering Party recognizes the parameters offered by the Contractor indicated in Annex 3 to the SWZ OPZ as the relevant proof. 13. Contractors who are not subject to exclusion on the terms specified in Chapter VI of the SWZ and meet the conditions for participation in the procedure defined by the Ordering Party may apply for the award of the contract. 14. Contractors who meet the conditions regarding: 14.1. ability to operate in the economic turnover The Ordering Party does not set a condition in this regard. 14.2. qualifications to conduct certain business or professional activities, as arising from separate regulations The Ordering Party does not set a condition in this regard. 14.3. economic or financial situation The Ordering Party does not set a condition in this regard. 14.4. technical or professional qualifications The Ordering Party sets a condition in this regard. The Ordering Party will consider the condition to be met if the Contractor demonstrates that it has duly executed at least one order (contract) involving the delivery of an unmanned flying system of the multirotor type with measuring sensors worth a minimum of PLN 200,000.00 gross during the last three years preceding the deadline for submitting offers (and if the period of operation is shorter - in this period).
