The subject of this public procurement is 'service' within the meaning of Article 3, paragraph 1, item 3 of the Public Procurement Act.
The activities included in the subject of the procurement are as follows:
For all separated lots:
Exercising construction supervision, according to Article 166, paragraph 1, item 1 of the Spatial Planning Act, including:
- Reporting on the progress of construction and the performed construction and assembly works (preparation of monthly or extraordinary report; verification and approval of the monthly reports of the construction contractor; preparation of minutes from working meetings with the participants in the construction; verification and certification of the quantity and values of the performed construction and assembly works for the execution of the construction, etc.), including signing the protocols for reporting the actually completed construction and assembly works by quantities and prices (Act Form 19);
- Performing the functions of a safety and health coordinator, according to the requirements of Article 5, paragraph 3 of Ordinance No. 2 from 2004 on the minimum requirements for healthy and safe working conditions during construction and installation works;
- Implementation of activities for investor control at the construction stage.
- Exercising construction supervision during the removal of manifested hidden defects during the warranty periods;
- Preparation of a final report, in accordance with Article 168, paragraph 6 of the Spatial Planning Act;
- Conducting inspection and control of the delivered and incorporated construction products in the construction, which ensure compliance with the main requirements for constructions, in accordance with the requirements of the regulation under Article 9, paragraph 2, item 5 of the Law on Technical Requirements for Products during the exercise of construction supervision activities.
Coordination of the construction process until the commissioning of the facility;
The execution of the activities is carried out in accordance with the Technical specification, an integral part of this documentation.
***IMPORTANT! In accordance with the opportunity under Article 104, paragraph 2 of the Public Procurement Act, in conducting this procedure, the evaluation of the technical and price proposals of the participants will be made before reviewing the documents for compliance with the requirements for personal condition and with the selection criteria.
The deadline for the execution of each specific contract begins to run from the conclusion of the contract and is determined in accordance with the construction execution deadline for the specific facility. The contract is considered executed with the commissioning of the facility.
The stipulated deadlines for the execution of construction and assembly works for each of the facilities, subject to a separate lot, are as follows:
- Facility: Improvement of the energy characteristics of the multi-family residential building, block 'Lisets' – Ruse, through the application of sustainable integrated high-efficiency energy measures” – no later than May 1, 2026.
- Facility: Improvement of the energy characteristics of the multi-family residential building, block 'Tisa' – Ruse, through the application of sustainable integrated high-efficiency energy measures” – no later than May 1, 2026.
LOT-0001
Implementation of activities for construction supervision and investor control for the facility: Improvement of the energy characteristics of the multi-family residential building, block 'Lisets' – Ruse, through the application of sustainable integrated high-efficiency energy measures.
Exercising construction supervision, including investor control: the contractor is responsible for the activities and obligations as a participant in the investment process regulated in Articles 166 and 168 of the Spatial Planning Act, as well as for those arising from Article 178 of the Spatial Planning Act. The construction supervision is carried out in the mandatory scope in accordance with the requirements of the Spatial Planning Act, the requirements of Ordinance No. 3 from 2003 on the preparation of acts and protocols during construction, taking into account the requirements of the Regulation for the essential requirements for constructions and the evaluation of the compliance of construction products and all legal and subordinate regulatory acts in the field of construction in Bulgaria.
Exercising construction supervision, according to Article 166, paragraph 1, item 1 of the Spatial Planning Act, including:

- Conducting inspection and control of the delivered and incorporated construction products in the construction, which ensure compliance with the main requirements for constructions, in accordance with the requirements of the regulation under Article 9, paragraph 2, item 5 of the Law on Technical Requirements for Products during the exercise of construction supervision activities.
Coordination of the construction process until the commissioning of the facility;
Regardless of the obligations imposed by law, during the implementation of construction supervision and investor control, the contractor is also responsible for:
control of temporary traffic organization plans in accordance with Bulgarian legislation, including through their application;
organizing the opening of the construction site for the facility within one month from receiving the commissioning letter from the Contracting Authority, accompanied by information about the effective building permit and a contract signed with the contractor for construction and assembly works;
documentary and physical inspection for compliance of the materials incorporated in the facility;
approval of the materials used in the facility and the documents generated during the construction;
conducting documentary and physical inspection of the construction process;
creating and keeping daily logs of the site, including information about working machinery, staff and circumstances, including accidents caused, as well as requirements from the builder for the corresponding daily information. The logs should include photographic material;
requirement for presentation from the builder and approval of detailed methods of execution of construction and installation works, as well as their scope, before their commencement;
assessing and certifying the works, measuring and certifying the quantities, according to the nature of the facility, including signing the protocols for reporting the actually completed construction and assembly works by quantities and prices (Act Form 19);
control of tests and trials of the facility (when applicable), as well as performing extraordinary tests and trials at one's own discretion or at the request of the Contracting Authority.
consulting with the Contracting Authority on all change orders and obtaining its prior written approval before ordering changes, as well as consulting with the Contracting Authority on all matters requiring this according to the contractual terms of the construction contract/construction contracts;
drafting acts and protocols during the construction in accordance with applicable legislation;
preparing reports and opinions for the Contracting Authority; organizing and conducting recorded meetings for the progress of the construction contract/construction contracts;
overall control and preservation of all documentation for the execution of the construction contract, requests for approval of materials and documents, certificates and declarations of compliance, acts, protocols, certificates for samples, measurements, executive documentation, minutes of meetings, financial documentation, general correspondence, correspondence regarding claims and processing of changes, as well as all other documents issued by the participants in the construction process or other parties generated in the course of the construction execution and having relevance for it;
control of the preparation and review of executive documentation (completeness, correctness, and completeness);
performing ongoing control of the implementation of the Waste Management Plan of the construction site and the movement and deposition of construction waste.

Implementation of activities for construction supervision and investor control for the facility: Improvement of the energy characteristics of the multi-family residential building, block 'Tisa' – Ruse, through the application of sustainable integrated high-efficiency energy measures.
Exercise of construction supervision, including investor control: the contractor is responsible for the activities and obligations as a participant in the investment process, regulated by Article 166 and Article 168 of the Spatial Development Act (ZUT), as well as those arising from Article 178 of the ZUT. Construction supervision is carried out within the mandatory scope in compliance with the requirements of the ZUT, the requirements of Regulation No. 3 of 2003 for the preparation of acts and protocols during construction, taking into account the requirements of the Regulation for the essential requirements for construction works and evaluating the compliance of construction products and all legal and sub-legal norms in the field of construction in Bulgaria.
Exercise of construction supervision according to Article 166, paragraph 1, item 1 of the ZUT, including:
- Tracking the progress of construction works and performed construction and assembly works (preparation of monthly or extraordinary reports; verification and approval of monthly reports by the construction contractor; preparation of minutes from working meetings with construction participants; verification and certification of the quantity and values of performed construction and assembly works for construction execution, etc.), including signing the protocols for reporting the actual completed construction and assembly works by quantities and prices (Act Form 19);
- Performing the functions of safety and health coordinator according to the requirements of Article 5, paragraph 3 of Regulation No. 2 of 2004 for the minimum requirements for healthy and safe working conditions during construction and assembly works;
- Carrying out investor control activities during the construction stage.
- Exercising construction supervision during the rectification of identified hidden defects during the warranty periods;
- Preparing a final report according to Article 168, paragraph 6 of the ZUT;
- Conducting checks and control of delivered and incorporated construction products, which ensure compliance with the essential requirements for constructions in accordance with the requirements of the regulation under Article 9, paragraph 2, item 5 of the Law on Technical Requirements for Products when performing construction supervision activities.
Coordination of the construction process until the construction is put into operation;
Regardless of the legal obligations imposed on them, in performing construction supervision and investor control, the contractor is also responsible for:
monitoring plans for temporary organization of traffic in accordance with Bulgarian legislation, including their implementation;
organizing the opening of the construction site for the project within 1 month of receiving a letter of assignment from the Client, accompanied by information on the valid construction permit and signed contract with the contractor for construction and assembly works;
documentary and physical verification for compliance of the materials incorporated in the project;
approval of the materials incorporated in the project and the documents generated during the construction process;
performing documentary and physical verification of the construction process;
creating and maintaining daily logs of the project, including information about working equipment, personnel, and circumstances, including identified and caused accidents, as well as requests from the builder for the corresponding daily information. Photographic materials should be attached to the logs;
requiring from the builder the presentation and approval of detailed methods for performing construction and installation works, as well as their scope, before their commencement;
evaluating and certifying works, measuring and certifying quantities, according to the nature of the project, including signing protocols for reporting the actual completed construction and assembly works by quantities and prices (Act Form 19);
controlling tests and examinations of the project (when applicable), as well as performing extraordinary tests and examinations at their own discretion or at the request of the Client.
Consulting with the Client on all change orders and obtaining their prior written approval before ordering changes, as well as consulting with the Client on all matters that require it according to the contractual conditions of the construction contract/construction contracts;
preparing acts and protocols during construction according to applicable legislation;
preparing reports and opinions for the Client;
organizing and conducting documented meetings on the progress of the construction contract/construction contracts;
comprehensive control and storage of all documentation related to the execution of the construction contract, requests for approval of materials and documents, certificates and declarations of compliance, acts, protocols, test certificates, photographs, executive documentation, meeting minutes, financial documentation, general correspondence, correspondence regarding claims and processing changes, as well as all other documents issued by participants in the construction process or other parties, generated in the process of executing construction and related to it;
controlling the preparation and review of executive documentation (completeness, correctness, and organization);
performing ongoing control for implementing the Waste Management Plan for the construction site and the movement and depositing of construction waste.
The implementation of the activities is carried out in accordance with the Technical Specification, an integral part of this documentation.
The execution period for each specific contract begins to run from the moment the contract is concluded and is determined in accordance with the construction execution time for the specific project. The contract is considered fulfilled upon the commissioning of the project. The specified deadlines for the execution of construction and assembly works for each of the projects, subject to an independent specified position, shall be no later than May 1, 2026.
