Description:
Production and delivery of six eco-friendly electric city buses and installation of four charging stations, along with necessary training and technical documentation for the transport operator in Siedlce.

I. The subject of the order in this procedure is:
1) production and delivery of 6 pieces of brand new, one brand, low-floor, single-section, eco-friendly maxi class city buses, powered by electricity, intended for use in public transport in the city of Siedlce and suburban lines equipped with a range of solutions improving the usability of public transport and passenger safety, as well as adapted to the needs of people with disabilities, referred to in the SWZ as "buses"; the order also includes granting authorization and equipping the technical background of the public transport operator in Siedlce – Miejskie Przedsiębiorstwo Komunikacyjne in Siedlcach Sp. z o.o. (referred to in the SWZ as the "Transport Operator") – with the necessary devices allowing for the diagnosis and technical repairs of the delivered vehicles;
2) delivery, installation, and commissioning of 4 pieces of brand new, stationary, electric, plug-in chargers, including:
a) 1 piece of dual-position charging station with a charging power of 2×60 kW at the MPK depot located at ul. Starzyńskiego 20, 1 piece of dual-position charging station with a charging power of 2×60 kW at ul. Kalinowej; and 2 pieces of single-position chargers with a power of 120 kW each at the Transfer Center located at ul. W. Pileckiego.
b) preparation of project documentation, installation of internal power supply lines necessary for powering the bus charging stations at the MPK depot, at the Transfer Center at ul. W. Pileckiego, at the bus loop at ul. Kalinowej. Obtaining permits and decisions necessary for launching the charging stations and obtaining technical acceptance. The charging station at the MPK depot does not require the execution of energy connections, as there is a prepared cable connection at the installation site for connecting the new station; only its connection to the power supply, appropriate placement, and integration into the telemetry system is required. Near the connection at the depot, there is a transformer with an adequate power reserve for the connection;
3) conducting training for the Transport Operator's employees regarding the operation and servicing of vehicles powered by electricity, managing the charging process of energy storage in buses, as well as managing and supervising the charging infrastructure, including the use of all supplied components,
4) delivery of technical-operational documentation (instructions, catalogs, diagrams, etc.), presented in the description of the subject of the order, regarding the buses and charging infrastructure,
5) delivery of equipment for the Transport Operator's service station, a set of tools and specialized devices enabling the acquisition of internal authorization from the bus and charging station manufacturers for the needs of the Contracting Authority.
The Contracting Authority reserves the right to conduct one-time inspections by three representatives during the production/construction/execution of electric buses at the place of production, at a date agreed with the contractor and at the contractor's expense.
The Contracting Authority, according to the requirements resulting from Art. 3e of Regulation (EU) 2019/1242 defining CO2 emission standards for new heavy vehicles and amending the Regulation of the European Parliament and Council (EC) No. 595/2009 and (EU) 2018/956 and Council Directive 96/53/EC (in the wording amended by Regulation of the European Parliament and Council (EU) 2024/1610 of May 14, 2024, amending Regulation (EU) 2019/1242 regarding stricter CO2 emission standards for new heavy vehicles and including reporting obligations, amending Regulation (EU) 2018/858 and repealing Regulation (EU) 2018/956), requires the Contractor to:
1) ensure the current availability of spare parts ensuring the functioning of the offered subject of the order,
2) continuously assess the availability of spare parts ensuring the functioning of the offered subject of the order,
3) ensure that any changes in its supply chain during the execution of the order will not negatively affect the execution of the order,
4) ensure such an organization of spare parts availability to meet the supply security requirement so that even any changes in the supply chain during the execution of the contract do not negatively impact its execution, while in accordance with Art. 7 point 10 of the Pzp Act, the term supply chain covers all resources and actions necessary for the execution of deliveries and services that are subject to the order, moreover, "supply chain" does not limit itself only to direct suppliers but also extends to subcontractors,
5) allow the purchase of parts for the delivered vehicles necessary for warranty and post-warranty repairs according to the provisions of § 11 sec. 12 of the contract for a period of at least 15 years counted from the date of final acceptance of the subject of the order.
The fulfillment of the Contractor's obligations mentioned in points 1-5 above aims to ensure the ongoing proper functioning of the vehicles that are the subject of the contract throughout the planned operating period of no shorter than 15 years.
Due to the limited character count, a detailed description of the subject of the order (OPZ), including requirements, technical parameters, and equipment that must be met and possessed by the offered subject of the order, is included as Attachment No. 7 to the SWZ, and Chapter 5 of the SWZ, which contains information regarding participation in this procedure by contractors/contractors jointly applying for the award of the contract/entities providing resources/subcontractors/further subcontractors from "third countries that are not parties to international agreements" and defines less favorable contract conditions for supplies from "third countries that are not parties to international agreements".
