Description:
The project provides legal assistance to the Federal Ministry for the Environment in addressing legal issues related to climate protection and energy law, including the development and evaluation of legal norms and measures necessary for achieving greenhouse gas neutrality.

The project aims to assist the Federal Ministry for the Environment, Climate Protection, Nature Conservation and Nuclear Safety (BMUKN) in addressing legal questions in the area of climate protection, environmental, and energy law. This includes clarifying legal questions in the fields of energy, industry, transport, buildings, waste management, agriculture, land use, land use change, and forestry (LULUCF), as well as taking into account and addressing European legal issues, including state aid and constitutional law questions. This also includes potential connections to the EU Climate Social Fund.

The project also involves assessing proposals for climate protection legal norms and climate protection measures at both the European and national levels. The consistency of these proposals with the existing national and European legal framework, and particularly with the legally established goal of greenhouse gas neutrality by 2045, is to be analyzed.

In approximately a quarter of cases, a socio-economic or legal factual impact analysis is also required alongside resolving legal questions. In about 10% of cases, substantial legal, economic, and social preliminary questions are to be developed for a possible further development of climate protection legal norms or climate protection measures, as required for legal reasons or based on legal factual effects.

The project is intended to support the BMUKN in preparing relevant dossiers at the EU level and preliminary questions for their implementation at the national level, as well as the further development of the national legal framework. The goal is to prepare legal, factual, economic, and social preliminary questions and base them on empirical data and legal analyses to improve the foundations for an effective and sustainable climate protection policy.
