Description:
The project involves expanding EDM and integrating it with P1 and PUI, including digitization and AI service platform integration, requiring a unified approach by a single contractor to ensure consistent implementation and operational continuity.

The subject of the order is the expansion of EDM and integration with P1 and PUI, including digitization and integration with the provided AI service platform under the National Reconstruction and Resilience Plan. The contracting authority does not allow for the submission of partial offers. The subject of the order includes the delivery of technologically complex software along with accompanying services, whose proper implementation, integration, and subsequent maintenance require ensuring full functional, technical, and operational coherence. For this reason, the order must be carried out as a unified and comprehensive project by a single contractor. Dividing the order into parts and assigning their execution to different contractors would carry a serious risk of inconsistency between individual components, difficulties in their integration, and lack of clear responsibility for the final result. In particular – as evidenced by the contracting authority's previous experience – cooperation with multiple entities leads to a dilution of responsibility, mutual shifting of blame in cases of defects or failures, and also prolongs the implementation process. Such situations result in system downtime, which can directly threaten the continuity of critical activities for the contracting authority's medical operations. Additionally, the complex nature of the order – encompassing not only delivery but also installation, configuration, testing, commissioning, and the provision of support and service – requires coordination of all stages by one entity. Only in this model is it possible to ensure full hardware-software compatibility and meet stringent time requirements regarding service responses and warranty repairs, which are crucial for maintaining the institution’s operational continuity. As a result, not dividing the order into parts is not only technically justified but also necessary from the perspective of ensuring effective, safe, and timely order execution and minimizing risks associated with the operation of the IT infrastructure supporting the statutory activities of the contracting authority. The contracting authority does not anticipate awarding contracts referred to in Article 214(1)(7) and (8) of the Public Procurement Law. A detailed description and method of execution of the order are included in the price list in Appendix No. 2 to the SWZ and the description of the subject of the order ("OPZ") in Appendix No. 3 to the SWZ, as well as the template agreement in Appendix No. 5 to the SWZ. According to Article 13(1) and (2) and Article 14(1) and (2) of the Regulation of the European Parliament and Council (EU) 2016/679 of April 27, 2016, regarding the protection of individuals concerning the processing of personal data and the free flow of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 2016 No. 119, p. 1) ("GDPR"), we would like to inform you about the rules for processing personal data in cases where the contracting authority processes your personal data in connection with the public procurement procedure.
2. The controller of your personal data is the contracting authority.
3. You can contact the contracting authority regarding issues related to personal data protection:
1) by sending a letter to its registered office or electronically via email to: dyr@imid.med.pl, or
2) through the ePUAP platform at address: /IMiDWarszawa/SkrytkaESP.
4. The contracting authority has appointed a Data Protection Officer ("DPO"), with whom you can contact regarding the processing of your personal data. Contact with the DPO is possible via email at: iod@imid.med.pl, by phone at (22) 32 77 495, or in writing to the headquarters of the contracting authority.
5. The contracting authority processes your personal data for the following purposes:
1) to conduct the public procurement procedure – based on Article 6(1)(c) GDPR in conjunction with Article 9(2)(g) GDPR in conjunction with the provisions of the Public Procurement Law;
2) to verify information concerning criminal records within the framework of substantive evidence – based on Article 6(1)(c) in conjunction with Article 10 GDPR in conjunction with the provisions of the Public Procurement Law;
3) to archive personal data – based on Article 6(1)(c) GDPR in conjunction with Article 9(2)(j) GDPR in conjunction with the National Archival Resource and Archives Act;
4) to establish, pursue, or defend claims related to conducted activities – based on Article 6(1)(e) GDPR or Article 9(2)(f) GDPR, i.e., processing is necessary for performing tasks carried out in the public interest – proper management of the contracting authority's assets, i.e., conducting an important public procurement procedure ensuring proper expenditure of public funds. Detailed GDPR information clauses are included in the SWZ.
