Description:
The project involves the replacement of the integrated PACS system, including data migration and the provision of review and diagnostic stations, server equipment, and necessary software, supported by financial resources aimed at health sector investments.

1. The subject of the order is:
1) the delivery by the Contractor of review stations, diagnostic stations, server equipment, and accompanying software and licenses for software as described in the Description of the Subject of the Order, which constitutes Appendix No. 6 to this SWZ (hereinafter collectively referred to as: "Equipment"),
2) the replacement by the Contractor of the integrated PACS system along with data migration and the installation of software (by migration, the Ordering Party understands the transfer of data in DICOM format from the currently operating system to the new environment while maintaining all diagnostic properties of the migrated data).
in accordance with the price form constituting Appendix No. 2 to the SWZ and the projected provisions of the contract constituting Appendix No. 4 to the SWZ.
2. The subject of the order is implemented as part of financial support for investments in the health sector, based on an agreement concluded by the Ordering Party with Kujawsko-Pomorski Fundusz Rozwoju sp. z o. o., under Resolution No. 30/1448/24 of the Board of the Kujawsko-Pomorskie Voivodeship dated November 28, 2024 (hereinafter: the Project). The source of funding for the support under the program will be financial resources derived from the reuse of the financial perspective 2014-2020 under the agreement No. ZW-I.273.8.2024 for entrusting a public task concluded on January 31, 2024, between the Kujawsko-Pomorskie Voivodeship and Kujawsko-Pomorski Fundusz Rozwoju sp. z o. o. The support referred to above will take the form of a loan with the obligation of partial repayment of the borrowed capital, which will finance 100% of qualified expenses.
The Ordering Party informs that in the proceedings conducted in the mode of an open tender, it provides for the possibility of applying the procedure referred to in Article 139 paragraph 1 of the Public Procurement Law. The Ordering Party, using the aforementioned procedure, will first examine and evaluate the offers, and then carry out the qualification of the Contractor whose offer has been rated highest in terms of the absence of grounds for exclusion and meeting the participation conditions in the proceeding.

3. The Contractor in Appendix No. 6 to the SWZ (in two sheets) is required to indicate respectively: (in the required parameters sheet) in the place STATE** Manufacturer, name and version of the software, (in the assessed parameters sheet) in the place *STATE YES/NO.
4. In the event that references to standards, technical assessments, technical specifications, and reference systems referred to in Article 101 paragraph 1 point 2 and paragraph 3 of the Public Procurement Law are made in the description of the subject of the order, the Ordering Party in accordance with Article 101 paragraph 4 of the Public Procurement Law allows for the application of equivalent solutions to those described. Whenever a standard, technical assessment, technical specification, or reference technical system is indicated in this SWZ, it should be assumed that the term "or equivalent" is used in relation to them.
5. In the case of the Ordering Party indicating in the description of the subject of the order a trademark, patent, or origin, source, or special process that characterizes the products - it should be assumed that the indicated trademarks, patents, origins, etc. define the minimum parameters indicated in Appendix No. 6 to the SWZ, which are criteria used to assess equivalence. Whenever a trademark, patent, or origin, source, or special process that characterizes the products is indicated in this SWZ, it should be assumed that the term "or equivalent" is used in relation to them (legal basis Article 99 paragraphs 5 and 6 of the Public Procurement Law).
