1. The subject of the order is the delivery of cargo van vehicles in unmarked police version. 2. The delivery includes new vehicles, produced in 2025, meeting all minimum requirements described in attachments 1, 1.1, 1.2 to SWZ. As part of the subject of the order, the Ordering Party will apply the option right referred to in Article 441 paragraph 1 of the Pzp Act. The Ordering Party guarantees the purchase of 3 vehicles. The delivery of additional vehicles, up to a maximum of 2 units, will depend on the actual needs of the Ordering Party and its financial capabilities. 3. The order is not divided into parts - the Contractor is obliged to submit an offer for the total number of vehicles encompassing both the guaranteed order and the optional order. 4. Requirements for accessibility for persons with disabilities. With regard to the condition specified in Article 100 of the Pzp Act concerning accessibility for persons with disabilities, as referred to in Directive PE and Council 2014/24/EU of 26.02.2014 on public procurement, the transportation of these persons will be carried out by other vehicles adapted for such transport within the equipment held by the Police or through authorized medical transport for persons with disabilities. The Ordering Party has included in the description of the subject of the order the required product (vehicle) characteristics, including adaptation to the needs of all users. Employees of the Ordering Party who will use the vehicle are not persons with disabilities. 5. Information concerning employment requirements based on an employment relationship. There are no activities related to the execution of the order consisting of performing work in the manner specified in Article 22 § 1 of the Act of June 26, 1974 - Labor Code - one-time delivery. 6. Place of delivery: The Contractor is obliged to deliver the vehicles to the Transport Department of KWP in Wrocław, 54-151 Wrocław, ul. Połbina 1. 7. Contractors applying for the award of the order are obliged to attach to the submitted offer the below-indicated subject-related evidence confirming that the offered delivery meets the requirements, characteristics, and criteria specified by the Ordering Party. 7.1. An excerpt from the vehicle type approval certificate for the base vehicle or the EC compliance certificate for complete vehicles, confirming the vehicle parameters that are the basis for calculating points in non-price criteria. The Ordering Party requires the attachment to the offer of: "Document confirming the fulfillment of the requirement (EC compliance certificate for the base vehicle) (.......)," understanding under this term the presentation of a template of such a document for a vehicle that is the same (same make and type and having the same technical parameters, including those subject to assessment under non-price criteria) as the offered one. The document constitutes subject-related evidence confirming that the offered vehicles meet the Ordering Party's minimum requirements regarding: - Type of engine, - Maximum permissible total weight, - Width of the vehicle, - Engine displacement, - Overall length of the vehicle, - Height of the vehicle, - Maximum net engine power, - Maximum speed, i.e., parameters described in points 4, 5, 6, 7, 8, 9, 10, 11 of attachment 1.1 to SWZ and will be the basis for awarding points in non-price evaluation criteria concerning the engine power, engine displacement, and emission height. An excerpt from the vehicle type approval certificate for the base vehicle or the EC compliance certificate constitutes confirmation that the offered vehicle meets the minimum parameters described in SWZ (attachment 1.1 to SWZ), and is the basis for awarding points in non-price evaluation criteria - this document may not be supplemented (is the content of the offer), and an offer submitted without this document is subject to rejection. 7.2. A declaration confirming that the offered deliveries meet the requirements specified in attachments 1, 1.1, 1.2 to SWZ made by filling and signing attachments number 1.1, 1.2 to SWZ. 8. Form of subject-related evidence - Chapter VI point 2 SWZ. 9. Supplementing and explaining the content of the subject-related evidence: - An excerpt from the vehicle type approval certificate for the base vehicle or EC compliance certificate for complete vehicles - may not be supplemented. - If the Contractor does not submit declarations constituting subject-related evidence or the submitted evidence is incomplete, the Ordering Party will call for their submission or supplementation within a specified time limit. 10. RODO information clause - Chapter II SWZ. 11. The Ordering Party anticipates applying the procedure from Article 139 of the Pzp Act, the so-called "reverse procedure," i.e., the Ordering Party may first conduct an examination and evaluation of the offers, and then qualify the Contractor whose offer has been rated the highest in terms of the absence of exclusion grounds. 12. The Ordering Party does not reserve the possibility of applying for the award of the order exclusively by Contractors referred to in Article 94 of the Pzp Act. 13. The Ordering Party anticipates the possibility of providing advance payments for the execution of the order - information regarding advance payments is contained in §6 PPU. 14. Acceptable changes to the contract - Chapter XXIII point 2 SWZ. 15. The deadline for delivery of the guaranteed order is: 20 calendar days from the date of signing the contract. The deadline for delivery of the optional order is 20 calendar days from the date of sending the notification of exercising the option right. The Ordering Party will notify the Contractor in writing of the exercise of the option right within 20 calendar days from the date of signing the contract. 16. The Ordering Party does not require the submission of a bid bond. 17. The deadline for binding the offer: January 25, 2026.

1. Documents to be submitted with the offer: 1.1. Completed and signed offer form containing information specified in attachment no. 2 to SWZ. 1.2. Subject-related evidence referred to in Chapter VI SWZ, i.e., approval certificate or EC compliance certificate for complete vehicles and completed and signed declarations constituting subject-related evidence (attachments no. 1.1, 1.2 to SWZ). 1.3. Completed, to the extent indicated by the Ordering Party, current on the day of submitting offers and signed declarations referred to in Article 125 of the Pzp Act (JEDZ – attachment no. 3 to SWZ and declaration of non-exclusion resulting from the EU regulation and related to the Act of April 13, 2022 on special solutions for counteracting aiding aggression against Ukraine and serving national security protection - attachment no. 3.1 to SWZ). In JEDZ, the indicated non-crossed parts should be filled: - the indicated non-crossed fields in part II - the indicated non-crossed fields in part III - in part IV, only field alpha should be filled (general statement regarding all qualification criteria) - part VI final declarations (the dotted fields should be filled and signed with a qualified electronic signature) In the case of joint application by Contractors for the order (consortia, civil partnerships), the JEDZ declaration and the declaration that there are no exclusion grounds referred to in: Article 5k of regulation (EU) 833/2014 as amended by regulation 2022/576 (EU) and in Article 7 paragraph 1 of the Act of April 13, 2022 on special solutions for counteracting aiding aggression against Ukraine and serving national security protection, shall be submitted by each of the Contractors jointly applying for the order (each consortium member, each partner in a civil partnership). These declarations are to confirm non-exclusion where each Contractor shows non-exclusion. 1.4. If the offer (or any documents attached to the offer) is signed by a person not mentioned in the Contractor's registration documents, a power of attorney must be attached to the offer. The power of attorney to submit the offer must be submitted in original form in the same manner as the submitted offer (i.e., in the electronic form bearing a qualified electronic signature). The electronic power of attorney, affixed with a qualified electronic signature, must be attached to the offer. If the power of attorney has been prepared as a paper document and signed by hand, the Contractor submits a digital representation of this document affixed with a qualified electronic signature confirming compliance of the digital representation with the paper document. The compliance confirmation of the digital representation with the paper document is to be made by a notary or the principal. The electronic copy of the power of attorney (its digital representation) cannot be authenticated by the authorized person. 1.5. Additionally, Contractors jointly applying for the award of the order (e.g., civil partnerships, consortia): - pursuant to Article 58 paragraph 2 of the Pzp Act, Contractors jointly applying for the award of the order are obliged to appoint a proxy. This power of attorney must be attached to the offer. The content of the power of attorney should unambiguously state the proxy's right to represent the Contractor in the public procurement procedure or to represent in the procedure and conclude a contract for public procurement in the name of the Contractor. This document must be signed by the person(s) authorized to grant it, namely in accordance with the form of representation of each Contractor (NOTE!!! The power of attorney is signed only by the principal with a qualified electronic signature). In the case of civil partnership members, submission of the civil partnership agreement is permissible, from which the scope and manner of representation arise, and in the case of a consortium, submission of the consortium agreement (original - electronic form with qualified electronic signatures or a digital representation of this document affixed with a qualified electronic signature confirming compliance of the digital representation with the paper document signed by principals or a notary)
