Description:
Supply of 30 electric buses and 30 charging stations for public transport in Voluntari, contingent upon securing financing.

Supply of 30 electric buses, slow charging stations (23 units) and fast charging stations (7 units). The electric buses and charging stations will serve public passenger transport. The electric buses will be of the solo type (non-articulated), will be equipped with facilities for access for persons with reduced mobility, will be low-floor, CE body, intended for urban passenger transport according to Directive 2007/46/EC, 2009/33/EC, UN-ECE R 66, Law 92/2007, with all subsequent amendments and completions. Details regarding the procurement can be found in the Terms of Reference. NOTE: Deadlines for submitting/responding to requests for clarification/additional information: A. In accordance with the provisions of art. 160 para. (1) of Law no. 98/2016 with subsequent amendments and completions, the deadline by which any interested economic operator has the right to request clarifications or additional information regarding the awarding documentation is 20 days before the deadline for submitting offers; B. In accordance with the provisions of art. 160 para. (2) of Law no. 98/2016, with subsequent amendments and completions, the contracting authority will respond clearly and completely to all requests for clarification within one day, namely by the 11th day before the deadline for submitting offers, through a consolidated answer, provided that the requests for clarification are submitted within the specified timeframe. SUSPENSIVE CLAUSE: The award procedure/acquisition is initiated under the incidence of this suspensive clause, in the sense that the conclusion of the public procurement contract is conditioned by the conclusion of the financing contract within the PR BI 2021-2027, PRIORITY 4 - A region with high mobility for the project 'Sustainable urban mobility in the City of Voluntari - Transition to zero carbon dioxide emissions in public transport, Stage 1', for which the City of Voluntari will submit a financing request. In the PR BI call P4/4.1/4.2/1/2025. Thus, the signing of the supply contract will be carried out in compliance with the provisions regarding the commitment of expenses from budgets that fall under the legislation regarding public finances. Considering the provisions of Law 98/2016 and HG no. 395/2016 with subsequent amendments and completions, the AC specifies that it will conclude the contract with the bidder declared winner only insofar as the necessary funds for the purchase are secured by signing the financing contract within PR BI 2021-2027, Priority 4 - A region with high mobility for the mentioned project. In case, regardless of the reasons, the financing contract within PR BI 2021-2027, Priority 4 is not signed, the AC, upon receiving notification from ADR Bucharest-Ilfov, as the Managing Authority for PR BI (MA PR BI), regarding the non-awarding of financing, reserves the right to cancel the awarding procedure, in the conditions where there is no other source of financing, in accordance with the provisions of art. 212 para. (1) lit. c) thesis 2 of Law 98/2016 with subsequent amendments and completions, making it impossible to conclude the public procurement contract. Bidders understand that the AC and/or ADR BI cannot be held responsible for any damages in the case of cancellation of the awarding procedure, regardless of the nature of these damages and regardless of whether the AC and/or ADR BI have been notified about the existence of such a damage. Bidders accept the use of the special conditions above/suspensive clause, taking full responsibility regarding any damages they might suffer in the situation described. The maximum period for which the suspensive clause operates is 18 months, meaning that if the condition for signing the financing contract is not met, the awarding procedure will be canceled, according to art. 212 of Law 98/2016. Bidders assume by submitting their offer the obligation to extend the validity of their offer and the participation guarantee, at the simple request of the AC, if it finds itself in the situation of applying the suspensive clause
