Seeking a project manager with legal expertise for technical assistance in managing and controlling ERDF co-financed programs, focusing on compliance audits, legal analysis, and system updates.

As part of the technical assistance for Luxembourg programs co-financed by the ERDF, the regional policy service of the Ministry of Economy is seeking a service contract for a duration of 3 years, extendable through a negotiated procedure based on Article 64 paragraph 5 of the Public Procurement Law: A confirmed project manager with higher education in law for a technical assistance mission for management and control, meeting the following profile (M/F): Firm tranche: Under the authority of the minister and the head of service, the provider will be tasked with delivering various services within the framework of technical assistance to the operational program for the period 2021-2027 as well as the subsequent one, based on a maximum annual limit of 1760 hours and commits to making every effort to comply with regulations concerning the monitoring, management, and control of the aforementioned program, particularly ensuring the following tasks: - administrative and legal audit of the execution of projects selected by the Managing Authority (legal and regulatory compliance, public procurement, state aids, eligibility of expenses, etc.); - analysis of positions taken by the European Commission or any other institution against the Managing Authority and preparing arguments supporting its approach; - preparing the defense of the interests of the Managing Authority against findings and interpretations of the European Commission or any other institution following a control; - Preparation, participation, and follow-up of the administrative and legal audit of the projects by national and European instances (General Inspectorate of Finance, European Commission, European Court of Auditors); - Preparation and adaptation of internal lines of conduct in regulatory areas (Public Procurement, State Aids, fraud, conflicts of interest, income, costs, etc.), - Adaptation and updating of internal and external working documents (agreement, management and control manual, all working documents). Optional annual tranche: Mission of annual update and follow-up of the management and control system of the ERDF AG (including the consideration of findings from system and operational audits): Content of the optional mission: - Updating and follow-up of procedures and control program - Updating and follow-up of control documentation - Updating and follow-up of paper and digital archiving methods of control documentation - Updating and follow-up of paper and digital control files - Updating and follow-up of control checklists (including public procurement and state aids) - Documentation methods and requirements for beneficiaries - Updating and follow-up of agreements and application forms - Updating and follow-up of assurance declarations - Harmonization and follow-up of documentation control nomenclature - Updating and follow-up of the management and control manual - Updating and follow-up of the anti-fraud system The amount proposed for the optional tranche may not exceed 50% of the total contract for the firm tranche and will be activated only at the decision of the contracting authority and subject to the budget during the 12-month period of each firm tranche fixed in the contract. Award criteria: - Higher education in European law (20 points), - Knowledge of the three Luxembourg administrative languages (Luxembourgish, French, German) (20 points), - Excellent knowledge of European Union law, specifically the regulations applicable to structural funds, public procurement, and state aids (20 points), - Experience of 3 to 5 years in the field of structural funds, preferably for a managing authority (20 points), - Experience of 3 to 5 years in the management and control of projects co-financed by structural funds (20 points), - Experience in national and European audits in the field of structural funds (20 points), - Proficiency in computer tools (10 points), - Knowledge of the Luxembourg economy appreciated (10 points), - Motivation, ability to work in a team, contact with European institutions (10 points) A total maximum of 20 or 10 points is awarded to each criterion indicated in the specifications. The price as specified in the financial claims of the candidate, formulated as an hourly rate expressed excluding VAT, constitutes an additional criterion that is attributed a total of 20 points. The evaluation of the optional tranche will be based on the same criteria as indicated above.
